Soil Use, Management, and Conservation LawUso, Manejo y Conservación de Suelos

Law 7779, 'Soil Use, Management, and Conservation,' establishes the legal framework for the protection, conservation, and recovery of soils in Costa Rica, under an integrated and sustainable management approach alongside other natural resources. It declares soil management, conservation, and recovery a matter of public interest for both state and private action. The law assigns functions to the Ministry of Agriculture and Livestock, in coordination with the Ministry of Environment and Energy, including the preparation of a binding National Plan and area-based plans (watersheds) for soil management, conservation, and recovery. It creates Area Committees with participation from producers and municipalities to direct and approve local plans. It imposes obligations on landowners and possessors regarding conservation practices, runoff control, and pollution prevention. The law includes fiscal and credit incentives tied to land use according to capacity, as well as penal and administrative sanctions for violations. It mandates inter-institutional coordination to prevent soil degradation from agricultural activities, infrastructure, agrochemicals, and other sources, and amends related legislation to align with soil conservation objectives.La Ley 7779, 'Uso, Manejo y Conservación de Suelos', establece el marco legal para la protección, conservación y recuperación de los suelos en Costa Rica, bajo un enfoque de gestión integrada y sostenible con los demás recursos naturales. Declara de interés público la acción estatal y privada para el manejo, conservación y recuperación de suelos. Define funciones para el Ministerio de Agricultura y Ganadería en coordinación con el Ministerio de Ambiente y Energía, incluyendo la elaboración de un Plan Nacional y planes por áreas (cuencas) de manejo, conservación y recuperación de suelos, de acatamiento obligatorio. Crea Comités por áreas, con participación de productores y municipalidades, para dirigir y aprobar los planes locales. Establece obligaciones para propietarios y poseedores de tierras, incluyendo prácticas de conservación, control de escorrentía y prevención de contaminación. Contempla incentivos fiscales y crediticios ligados al uso del suelo conforme a su capacidad, así como sanciones penales y administrativas por infracciones. Ordena la coordinación interinstitucional para evitar la degradación del suelo causada por actividades agropecuarias, infraestructura, agroquímicos y otras fuentes. Reforma leyes conexas para alinearlas con sus objetivos de conservación del recurso suelo.

Strict Liability for Environmental DamageResponsabilidad objetiva por daño ambiental

The Third Chamber held that civil liability for environmental damage is governed by a strict-liability standard when the applicable statutory requirements are met. Unlike ordinary fault-based liability, the injured party need not prove intent or negligence: establishing the damage and a causal connection to the attributed act or omission is sufficient. The defendant bears the burden of proving a valid ground for exoneration. The Chamber therefore granted the Attorney General’s appeal and partially reversed the appellate judgment, which had treated liability under environmental and soil-conservation legislation as fault-based. The Chamber did not itself hold the civil defendant liable or disturb his criminal acquittal; instead, it directed the appellate court to examine the civil claim comprehensively under the strict-liability framework. By majority, it also denied the Public Prosecutor’s appeal concerning restoration, although a dissenting justice concluded that prosecutors had standing to seek restoration of the affected land and favored remanding that issue to a differently constituted appellate panel.La Sala Tercera resolvió que la responsabilidad civil por daño ambiental se rige por un criterio objetivo cuando concurren los presupuestos legales correspondientes. A diferencia del régimen ordinario fundado en la culpa, la persona afectada no debe demostrar dolo o negligencia: basta acreditar el daño y el nexo causal con la acción u omisión atribuida. La carga de demostrar una causa de exoneración recae sobre el demandado. Por ello, acogió el recurso de la Procuraduría y revocó parcialmente la sentencia de apelación, que había interpretado como subjetiva la responsabilidad contemplada en la legislación ambiental y de conservación de suelos. La Sala no declaró directamente responsable al demandado civil ni alteró su absolutoria penal; ordenó al tribunal de apelación examinar integralmente la pretensión civil conforme al régimen objetivo. Por mayoría rechazó, además, el recurso del Ministerio Público relacionado con la restitución, extremo respecto del cual hubo voto salvado favorable al reenvío.

Water Contamination by Bromacil from Pineapple Plantation in SiquirresContaminación del agua con Bromacil por plantación de piña en Siquirres

The Constitutional Chamber granted an amparo filed by residents of Cairo, La Francia and Luisiana in Siquirres, who claimed that the pineapple plantation of Hacienda Ojo de Agua S.A. contaminated the water sources feeding their aqueducts with agrochemicals — primarily the herbicide Bromacil. The Chamber found it proven that the plantation sits atop the aquifer that feeds those springs, that pesticide levels exceed the European precautionary standard of 0.1 μg/L, and that there is evidence of potential carcinogenicity. It held that, in the absence of domestic regulation on pesticide residues in drinking water, the precautionary principle must apply, and ordered the respondent ministries and AyA to immediately begin a single cleanup plan to eliminate residues, coordinated by the Ministry of Health, with authority to impose restrictions on the company up to and including closure of the plantation. The amparo against the company was rejected because it is not a proper amparo respondent, though this does not exempt it from legal liability.La Sala Constitucional declaró con lugar un amparo interpuesto por vecinos de las comunidades de Cairo, La Francia y Luisiana en Siquirres, quienes denunciaron que la plantación de piña de la empresa Hacienda Ojo de Agua S.A. contaminaba con agroquímicos —principalmente el herbicida Bromacil— las fuentes de agua que abastecen sus acueductos. La Sala tuvo por probado que la plantación se asienta sobre el manto acuífero que nutre dichas nacientes, que los niveles de plaguicidas presentes en el agua superan la norma precautoria europea de 0.1 μg/L y que existe evidencia de potencial carcinogenicidad. Estableció que, ante la falta de normativa nacional sobre residuos de plaguicidas en agua de consumo humano, debe aplicarse el principio precautorio y ordenó a los ministerios demandados y al AyA iniciar de inmediato un plan único de saneamiento y eliminación de los residuos, bajo coordinación del Ministerio de Salud, con facultad para imponer a la empresa restricciones hasta el cierre de la plantación. Rechazó el amparo contra la empresa por no ser sujeto de amparo, aunque eso no la exime de responsabilidades legales.

Forest Restoration Despite Criminal AcquittalRestauración del bosque pese a absolución penal

The Court of Criminal Sentence Appeals held that acquitting the defendants did not relieve the trial court of its duty to address restitution and restoration of two hectares of forest that had been cleared and replaced with avocado crops within a protected zone associated with a spring. Environmental restitution is distinct from damages and may be ordered by the court on its own motion, even without a civil damages action, to prevent the effects of the unlawful act from continuing and to protect the collective right to a healthy and ecologically balanced environment. The court therefore granted the Attorney General’s appeal, partially annulled the acquittal judgment, and remanded the case for a determination of forest-regeneration and crop-removal measures, after giving the property owner an opportunity to be heard. It denied the Public Prosecutor’s appeal because the doubt about the defendant’s knowledge that the required forestry permits were absent was reasonable, and it otherwise affirmed the acquittal.El Tribunal de Apelación resolvió que la absolución penal de los imputados no liberaba al tribunal de juicio de pronunciarse sobre la restitución y restauración de dos hectáreas de bosque taladas y sustituidas por cultivos de aguacate dentro de una zona protectora asociada a una naciente. La restitución ambiental es una consecuencia distinta de la indemnización y puede ordenarse de oficio, aun sin acción civil resarcitoria, para impedir que perduren los efectos del hecho ilícito y proteger el derecho colectivo a un ambiente sano y ecológicamente equilibrado. Por ello, acogió el recurso de la Procuraduría, anuló parcialmente la sentencia absolutoria y ordenó el reenvío para decidir las medidas de regeneración del bosque y eliminación de los cultivos, previa audiencia al propietario del inmueble. En cambio, rechazó el recurso del Ministerio Público: consideró razonable la duda sobre el conocimiento del imputado acerca de la falta de permisos forestales y confirmó la absolución en lo restante.

Soil Use, Management and Conservation RegulationReglamento a la Ley de Uso, Manejo y Conservación de Suelos

This executive decree regulates the Soil Use, Management and Conservation Law (Law 7779) to protect, conserve and improve soils nationwide. It establishes the institutional framework led by the Ministry of Agriculture (MAG), a National Technical Commission and Area Committees to develop and implement conservation plans by watershed. It details management practices, permitted machinery, soil and water pollution control, subdivision requirements, land titling, water concessions, road infrastructure, agricultural burning, mining, and fiscal incentives. It creates summary administrative procedures and agrarian jurisdiction to sanction violations, with provisions on soil-conformity certifiers and citizen participation through public hearings.Este decreto ejecutivo reglamenta la Ley de Uso, Manejo y Conservación de Suelos (Ley 7779) para proteger, conservar y mejorar los suelos en todo el territorio nacional. Legal regime of spring protection areas and public ownership of waterRégimen jurídico de las áreas de protección de nacientes y el dominio público de las aguas

The Attorney General's Office analyzes a legislative inquiry on the legal regime of waters, particularly the protection areas of springs that supply communities. It distinguishes two regimes: the public domain regime applicable to drinking water supply sources under Articles 31 of the Water Law, 7.c of the Land and Settlement Law, and 2 of the General Potable Water Law, which establish an inalienable 200- or 300-meter strip; and the protection areas regime under Article 33 of the Forestry Law, which imposes social interest limitations on private property within a 100-meter radius without requiring compensation. It defines the competencies of the Water and Sewerage Institute (AyA) to determine drinking water sources and the Ministry of Environment (MINAE) for water use concessions, and clarifies that Article 50 of the Environmental Law reaffirms public ownership of water. Finally, it sets out the obligations and penalties for source contamination, and the responsibilities of the Ministry of Agriculture (MAG) and the Coffee Institute (ICAFE) in water resource protection.La Procuraduría analiza la consulta de un diputado sobre el régimen jurídico de las aguas, en particular las áreas de protección de nacientes que abastecen comunidades. Distingue dos regímenes: el de dominio público, aplicable a fuentes surtidoras de agua potable según los artículos 31 de la Ley de Aguas, 7.c de la Ley de Tierras y Colonización y 2 de la Ley General de Agua Potable, que establecen una franja inalienable de 200 o 300 metros; y el de áreas de protección del artículo 33 de la Ley Forestal, que impone limitaciones de interés social a la propiedad privada en un radio de 100 metros, sin requerir indemnización. Define las competencias del AyA para determinar las fuentes de agua potable y del MINAE para las concesiones de aprovechamiento, y aclara que el artículo 50 de la Ley Orgánica del Ambiente reafirma el dominio público del agua. Finalmente, enumera las obligaciones y sanciones por contaminación de fuentes, y las competencias del MAG y del ICAFE en la protección del recurso hídrico.

Forest engineers may certify soil use conformityIngenieros forestales pueden certificar uso conforme del suelo

The First Chamber of the Supreme Court of Justice upheld the partial annulment of Decree 30636-MAG and an INTA order that restricted forest engineers to issuing soil use conformity certificates only for forestry projects. The Chamber held that the regulatory restriction exceeded the provisions of the Soil Use, Management and Conservation Law (No. 7779) and its executive regulation, which merely require the certificate to be issued by a professional authorized by the College of Agronomists, without distinguishing between agronomists and forest engineers. The restriction also lacked adequate technical reasoning, violating the principle of objective environmental protection and the professionals' fundamental rights. The Chamber further held that the challenged regulation was autonomous, not executive, and therefore could not regulate fundamental rights. Arguments about forest engineers' lack of qualifications were rejected, and it was noted that other land uses—such as scrubland, fallow land, or green zones—do not justify the exclusion. The appeal was partially allowed only to reverse the costs award, while the rest of the judgment was confirmed.La Sala Primera de la Corte Suprema de Justicia confirmó la anulación parcial del Decreto 30636-MAG y un oficio del INTA, que limitaban a los ingenieros forestales a emitir certificados de uso conforme del suelo únicamente para proyectos forestales. La Sala determinó que la restricción reglamentaria excedía lo dispuesto en la Ley de Uso, Manejo y Conservación de Suelos (N° 7779) y su reglamento ejecutivo, los cuales solo exigen que el certificado sea emitido por un profesional autorizado por el Colegio de Ingenieros Agrónomos, sin distinguir entre ingenieros agrónomos y forestales. Además, la restricción carecía de motivación técnica adecuada, violando el principio de objetivación de la tutela ambiental y los derechos fundamentales de los profesionales. La Sala también sostuvo que el reglamento impugnado era autónomo y no ejecutivo, por lo que no podía regular derechos fundamentales. Se rechazaron los argumentos sobre falta de idoneidad de los forestales y se señaló que otros usos de suelo —como charral, tacotal o zona verde— no justifican la exclusión. Se acogió parcialmente el recurso solo para anular la condenatoria en costas, manteniendo el resto del fallo.

Agrarian jurisdiction over boundary crops and soil damageCompetencia agraria por cultivos en lindero y daño al suelo

The Agrarian Tribunal resolves a jurisdictional challenge based on subject matter filed by the defendant in an ordinary proceeding. The plaintiff claimed damages from crops planted along the boundary and obstruction of a ditch, which harmed his plantations and sterilized the soil. The defendant argued her land is a lot for construction acquired through a housing bond, thus not agrarian. The Tribunal rejects the challenge and affirms agrarian jurisdiction, finding that the dispute involves agrarian production activities (subsistence crops), albeit on a small scale, and damage to the soil resource, a matter governed by the Soil Use, Management and Conservation Law, whose Article 56 assigns jurisdiction to agrarian courts.El Tribunal Agrario resuelve una excepción de incompetencia por razón de la materia interpuesta por la demandada en un proceso ordinario. Agrarian Jurisdiction over River-Material Extraction ContractsCompetencia agraria en contratos de extracción de material de río

The Agrarian Court held that the agrarian jurisdiction must hear the ordinary proceeding concerning performance of a private contract for the extraction of river material, even though the activity operates under a concession and is extractive in nature. It rejected the trial court’s jurisdictional declination, which had reasoned that material extraction was not an agrarian activity. The Court explained that agrarian jurisdiction encompasses not only crop and livestock production but also related activities and sustainable agro-environmental activities, particularly when the soil resource is involved. Relying on Article 56 of the Soil Use, Management and Conservation Law and precedents from the First Chamber and the Agrarian Court itself, it concluded that private disputes arising from the application of that legislation belong before the specialized agrarian courts. The Court also emphasized the cross-cutting nature of environmental law and returned the case to the originating court so that proceedings could continue unless another legal obstacle existed.El Tribunal Agrario resolvió que corresponde a la jurisdicción agraria conocer el proceso ordinario sobre el cumplimiento de un contrato privado para explotar material de río, aun cuando la actividad cuente con una concesión y tenga carácter extractivo. Rechazó la inhibitoria mediante la cual el juzgado de primera instancia había declinado competencia por considerar que la extracción de materiales no constituía actividad agraria. El Tribunal explicó que la competencia agraria comprende no solo la producción agrícola o pecuaria, sino también actividades conexas y agroambientales sostenibles, particularmente cuando está involucrado el recurso suelo. Con fundamento en el artículo 56 de la Ley de Uso, Manejo y Conservación de Suelos y en precedentes de la Sala Primera y del propio Tribunal, concluyó que los conflictos privados relacionados con la aplicación de esa legislación deben tramitarse ante la sede agraria. Destacó además el carácter transversal de la materia ambiental y devolvió el expediente al juzgado de origen para continuar su tramitación.

Dismissal of Nullity of Possessory Information Proceeding for Lack of Soil Use Study Given Non-Operational Certifier RegistryRechazo de nulidad de información posesoria por omisión del estudio de uso de suelos ante inoperatividad del registro de certificadores

The court dismisses a challenge to a possessory information proceeding, where the appellant argued that the required soil use conformity study under the Soil Use, Maintenance and Conservation Law (Law 7779) and its Regulations had not been submitted. The Chamber explains that, while the law requires the possessor to demonstrate—through a study prepared by a Certified Soil Use Conformity Certifier—that possession has been exercised in compliance with the land's designated use, this requirement was not enforceable at the time the proceeding began. The reason is that the Official Registry of Certified Soil Use Conformity Certifiers, created by Decree 30636-MAG and operated by INTA, was still in the implementation phase and its institutional and logistical structure was not yet fully established. Therefore, it was not unusual that neither the judge nor the procurator had demanded such a study at that point. The grievance is therefore rejected.El Tribunal rechaza un recurso de nulidad contra un proceso de información posesoria, en el cual el recurrente alegaba la falta del estudio de uso conforme del suelo exigido por la Ley de Uso, Mantenimiento y Conservación de Suelos (Ley 7779) y su Reglamento. La Cámara explica que, si bien la normativa requiere que el poseedor demuestre, mediante un estudio realizado por un Certificador de Uso Conforme del Suelo, que ha ejercido la posesión cumpliendo con el uso conforme del suelo, este requisito no era exigible al momento de iniciarse el proceso. Ello porque el Registro Oficial de Certificadores de Uso Conforme del Suelo, creado por el Decreto 30636-MAG y cuya operación correspondía al INTA, aún se encontraba en fase de implementación y su estructura logística no estaba plenamente consolidada. Por tanto, no resultaba extraño que ni el juez ni el ente procurador hubiesen requerido dicho estudio en aquel momento, lo que lleva a desestimar el agravio.

Unproven Damages in Agrarian Possessory LitigationDaños no probados en litigio posesorio agrario

The Agrarian Court decided an appeal brought by an estate seeking to invalidate a possessory-title proceeding, recover land in Guanacaste, and obtain damages. Although the appeal alleged procedural irregularities and possible omissions concerning springs, water resources, and forest protection, the Court left intact the rulings on registered ownership and the claimant’s failure to establish ten years of possession. It nevertheless partially reversed the judgment because the corporate counterclaimant failed to prove that the notation of the lawsuit caused actual loss. The Court explained that even an unliquidated award requires prior proof that damages exist; only their amount or extent may be deferred to the judgment-enforcement stage. Losses arising from frustrated sales, leases, mortgages, or other transactions cannot be inferred merely from the filing or registry notation of a claim. Because each side prevailed on part of the counterclaim, the Court also vacated the costs award and ordered that the counterclaim be resolved without a special award of costs.El Tribunal Agrario resolvió la apelación promovida por una sucesión que pretendía anular una información posesoria, recuperar una finca de Guanacaste y obtener daños y perjuicios. Aunque el recurso cuestionó irregularidades procesales y posibles omisiones relativas a nacientes, aguas y protección forestal, el Tribunal mantuvo lo resuelto sobre la titularidad registral y la falta de posesión decenal de la parte actora. Sin embargo, revocó parcialmente la sentencia porque la sociedad reconventora no demostró la existencia de los daños y perjuicios que atribuía a la anotación de la demanda. Precisó que una condena en abstracto exige probar previamente la realidad del daño; únicamente su cuantía o extensión puede diferirse a la ejecución de sentencia. La mera interposición y anotación de una demanda no permiten inferir automáticamente pérdidas por ventas, alquileres, hipotecas u otros negocios frustrados. Al existir vencimiento recíproco en la reconvención, eliminó también la condena en costas y resolvió ese extremo sin especial condenatoria.

National Plan for Soil Management and Conservation for Agroecological LandsPlan Nacional de manejo y conservación de suelos para las tierras de uso

Executive Decree No. 42316-MAG-MINAE establishes the National Plan for Soil Management and Conservation for agroecological lands in Costa Rica, in compliance with Law No. 7779. This plan contains binding general guidelines that must be followed by all ministries, decentralized institutions, state mixed-economy enterprises, and the private sector when undertaking programs or projects affecting these lands. The decree classifies lands into eight classes based on their use capacity (Class I through VIII), defining for each the permitted agricultural, livestock, or forestry activities, as well as the required management and conservation practices. El decreto clasifica las tierras en ocho clases según su capacidad de uso (de I a VIII), definiendo para cada una las actividades agrícolas, pecuarias o forestales permitidas, así como las prácticas de manejo y conservación requeridas. Además, establece áreas prioritarias de manejo por cuencas hidrográficas, criterios de impacto ambiental según la clase de tierra, y responsabilidades operativas lideradas por el Ministerio de Agricultura y Ganadería. Se derogan los artículos 1, 2 y 3 del Decreto N° 35216-MINAET-MAG que oficializaba el Programa de Acción Nacional de Lucha contra la Degradación de la Tierra, por no ajustarse a los requisitos de la Ley N° 7779.

It authorizes the use of these effluents only to improve the physical, chemical, and microbiological properties of soils intended for agricultural production. It grants the National Animal Health Service (SENASA) the power to impose sanitary measures in case of non-compliance and requires the approval of an agronomy professional for the application plan. It supersedes conflicting previous regulations and enters into force upon publication.Este decreto ejecutivo establece el marco normativo para el manejo y la aplicación de efluentes de granjas porcinas como mejoradores de suelos en todo el territorio nacional. Dispone que los efluentes, considerados una enmienda de origen natural, deben ser aplicados siguiendo un plan agronómico obligatorio que incluye análisis de suelos y del efluente, determinación de la demanda nutricional del cultivo y el cálculo del volumen de aplicación para evitar excesos y escorrentía. Classes I-III allow virtually unrestricted agricultural, livestock, or forestry activities; classes IV-VI are restricted to perennial/semi-perennial crops or forestry with conservation practices; class VII permits only forest management or natural vegetation; and class VIII excludes all productive use. It includes subclasses, management units, detailed factors and limiting conditions (slope, active erosion, effective depth, texture, stoniness, fertility, copper toxicity, salinity, drainage, flood risk, life zone, dry period, fog, wind), and recommended management practices. It repeals Executive Decree 23214-MAG-MIRENEM of 1994 and is mandatory for development studies, land titling, territorial planning, regulatory plans, subdivisions, environmental impact assessments, and land-use changes. Although extracting rock material is not itself an agrarian production activity based on a biological cycle, the remaining land retains the capacity for agrarian use, while mining directly affects the soil and subsoil. The Court explains that the activity performed is the primary criterion for determining agrarian subject-matter jurisdiction, supplemented by the property’s nature, productive capacity and size and by the status of the parties involved. It also relies on Article 56 of the Soil Use, Management and Conservation Law, which expressly assigns agrarian courts jurisdiction over matters arising from that statute. The Court therefore rejects the first-instance judge’s decision declining jurisdiction and orders that court to continue processing the land-titling proceeding.El Tribunal Agrario determina que la jurisdicción agraria debe continuar conociendo la información posesoria de un inmueble de casi dos hectáreas utilizado como casa de habitación y para la explotación comercial de una cantera o tajo. It defines administrative procedures for risk management due to soil contamination, compelling natural and legal persons engaged in industrial, commercial, service, or agricultural activities who handle regulated substances to report spills, conduct monitoring, and implement remediation plans under the supervision of the Ministry of Health. It creates an inter-agency Technical Committee to support the management of contaminated sites and provides sanctions under the Organic Environmental Law and the General Health Law. The regulation applies nationwide and aims to prevent harm to public health and the environment from soil and groundwater contamination.Este decreto ejecutivo establece listados de sustancias químicas y los valores guía (de prevención y de intervención) que, al ser sobrepasados en el suelo, indican riesgo para la salud humana y los ecosistemas. The First Chamber resolved a jurisdictional consultation arising from an eviction proceeding based on nonpayment and breach of contract concerning land leased exclusively for mining. The defendant argued that the dispute did not belong in agrarian jurisdiction, but the Agrarian Court rejected that objection because of the land’s use and its characterization as forest, pasture, and scrubland. The Chamber explained that soil is protected by both environmental law and agrarian law and that the Soil Use, Management and Conservation Law seeks its protection, conservation, and improvement through integrated and sustainable management with other natural resources. Under Article 56 of that law, agrarian courts hear matters arising from its application. The submitted certificate expressly stated that the land had not been used in conformity with the approved methodology and warned that shallow soil and surface and subsurface stoniness limited agricultural use. Although the certificate included recommendations for conserving natural resources, the trial court treated the requirement as satisfied without clarifying those observations or verifying compliance. The Court explained that agrarian property is subject to an economic, social, and environmental function, implemented through restrictions concerning land use, forests, water, biodiversity, and environmental impact assessment. In possessory title proceedings, the agrarian judge must verify compliance with agro-environmental rules and may order measures necessary to bring activities into conformity. Because the trial court omitted that responsibility, its judgment was premature and had to be vacated so that conforming land use could be properly verified.El Tribunal Agrario anuló la sentencia que había aprobado la información posesoria y ordenado inscribir el inmueble a nombre del promovente. The Court also emphasized that environmental matters are cross-cutting and must be incorporated throughout public administration, judicial jurisdictions, and private activities. Non-retroactivity of the soil-conformity requirement in possessory-information proceedings before the Agrarian TribunalIrretroactividad del requisito de uso conforme del suelo en información posesoria ante el Tribunal Agrario

The Agrarian Tribunal upheld the approval of a possessory information proceeding despite the property's non‑compliance with the soil‑conformity requirement — the slopes and terraces lacked vegetative cover. The Attorney General's Office opposed because Decree 29375‑MAG‑MINAE‑H‑HACIENDA‑MOPT, implementing Soil Law 7779, requires in Article 58 a soil study proving such conformity for titling. The Tribunal held that the usucapion had been perfected in 1976 — long before the decree took effect in 2001 — and that ownership is acquired upon consolidation of the usucapion, not upon registration. Retroactively applying Article 58 would impair vested rights. No obstante, aclaró que la aprobación de la información posesoria no impide que las autoridades ambientales y agropecuarias ejerzan sus potestades de fiscalización para garantizar el manejo, conservación y recuperación del recurso suelo conforme a la Ley 7779, incluso por la vía administrativa o penal.

Las inspecciones evidenciaron erosión, cárcavas, ausencia de manejo de escorrentías y peligro de deslizamiento para quienes habitaban en la parte inferior del terreno. Aunque el propietario no hubiera ejecutado personalmente las obras, consintió su realización sin adoptar medidas preventivas. Ante la falta de estudios técnicos que descartaran el riesgo, procedía mantener las medidas correctivas.

This decree creates the Official Registry of Soil Conformity Certifiers and the Applicants Evaluation Committee, pursuant to the Soil Use, Management and Conservation Law No. 7779. It establishes that MAG-INTA will maintain the registry and accredit professionals authorized to issue soil conformity certificates. It sets inscription requirements: membership in the Costa Rican College of Agronomist Engineers, a minimum bachelor's degree in Agronomic Engineering with emphasis in Phytotechnology or Generalist, or a minimum bachelor's in Forest Sciences with practical experience, plus passing a course taught by the College and MAG-INTA. The decree regulates the composition of the Evaluation Committee, the application procedure, the issuance of ID cards, administrative fees, and the College's supervisory powers over certifiers. It includes transitory provisions to start training. The norm aims to guide institutional efforts for soil conservation and watershed management in these geographic areas during the specified three-year period.El Decreto Ejecutivo N° 31051-MAG-MINAE-S-H-MOPT establece las cuencas hidrográficas prioritarias para la ejecución del Plan Nacional de Manejo y Conservación de Suelos durante el período 2002-2004, en cumplimiento de la Ley de Uso, Manejo y Conservación de Suelos (N° 7779) y su reglamento. La Comisión Técnica Nacional de Uso, Manejo y Conservación de Suelos seleccionó por unanimidad, mediante matriz de análisis multicriterio, las siguientes cuencas: Damas, Candelaria Parrita, Barranca, Grande de Tárcoles, Tempisque, Reventazón, Savegre y Banano. El decreto fundamenta su legalidad en los artículos 140 y 146 de la Constitución Política, la Ley General de la Administración Pública, la Ley de Fomento a la Producción Agropecuaria y la citada Ley 7779. La norma busca orientar los esfuerzos institucionales para la conservación de suelos y manejo de cuencas en esas áreas geográficas durante el trienio indicado.

Creation of the Advisory Commission on Land Degradation (CADETI)Crea la Comisón Asesora sore Degradación de Tierras (CEDETI)

Executive Decree 29279-MINAE-MAG created the Advisory Commission on Land Degradation (CADETI), attached to the Ministry of Environment and Energy in coordination with the Ministry of Agriculture and Livestock, as a consultative and technical body to promote compliance with the United Nations Convention to Combat Desertification. It established its composition with representatives from academia (University of Costa Rica), government (MINAE, MAG, IMN) and non-governmental sectors, defining its advisory, inter-institutional coordination, research promotion and project formulation functions for rehabilitation and prevention. The decree was repealed in 2009 by Executive Decree 35216, which created the National Commission to Combat Desertification and Drought (CONALDES) to update the institutional framework.El Decreto Ejecutivo 29279-MINAE-MAG creó la Comisión Asesora sobre Degradación de Tierras (CADETI), adscrita al Ministerio de Ambiente y Energía en coordinación con el Ministerio de Agricultura y Ganadería, como un órgano consultivo y técnico para impulsar el cumplimiento de la Convención de las Naciones Unidas de Lucha contra la Desertificación. Estableció su composición con representantes de los sectores académico (Universidad de Costa Rica), gubernamental (MINAE, MAG, IMN) y no gubernamental, definiendo sus funciones de asesoría, coordinación interinstitucional, promoción de investigación y formulación de proyectos de rehabilitación y prevención. El decreto fue derogado en 2009 por el Decreto Ejecutivo 35216, que creó la Comisión Nacional de Lucha contra la Desertificación y la Sequía (CONALDES) para actualizar el marco institucional.

Methodology for Determining Land Use CapacityMetodología Determinación Capacidad Uso Tierras Costa Rica

This executive decree establishes the official methodology to be applied in Costa Rica for evaluating, classifying, and planning land use according to its capacity. It defines eight classes (I through VIII) based on limitations of slope, erosion, soil, drainage, and climate, ranked from highest to lowest suitability for agricultural, livestock, and forestry activities. Classes I to III allow annual crops; IV to VI restrict use to semi-permanent and permanent crops and forestry; class VII only permits forest management or restoration; and class VIII is solely for resource protection. The methodology is mandatory for all agricultural, forestry, and natural resource protection strategies, policies, plans, and projects, both public and private, and aims to unify criteria to promote land-use planning consistent with sustainable development.Este decreto ejecutivo establece la metodología oficial que debe aplicarse en Costa Rica para evaluar, clasificar y planificar el uso de las tierras según su capacidad. Define ocho clases (I a VIII) basadas en limitaciones de pendiente, erosión, suelo, drenaje y clima, ordenadas de mayor a menor aptitud para actividades agrícolas, pecuarias y forestales. Las clases I a III permiten cultivos anuales; las IV a VI restringen el uso a cultivos semipermanentes, permanentes y producción forestal; la clase VII solo admite manejo forestal o restauración; y la clase VIII es exclusivamente para protección de recursos. La metodología es de aplicación obligatoria para todas las estrategias, políticas, planes y proyectos agropecuarios, forestales y de protección de recursos naturales, tanto públicos como privados, y busca unificar criterios para promover un ordenamiento territorial acorde con el desarrollo sostenible.

Prohibition for public officials to act as soil use certifiers due to conflict of interestProhibición para funcionarios públicos de actuar como certificadores de uso del suelo por conflicto de intereses

The Attorney General's Office concludes that MAG and INTA officials are prohibited from accrediting and privately practicing as certifiers of compliant soil use, as this creates a conflict of interest contrary to ethical principles of public service. The private activity would coincide with the functions of the employing body, granting undue advantages and compromising impartiality. Officials from other bodies may do so if there is no direct relationship with MAG functions, it is done outside working hours, and they are not under exclusive dedication. Temporarily suspending exclusive dedication or using vacations or unpaid leave to evade the prohibition is not allowed, as the employment relationship persists and ethical incompatibilities remain.La Procuraduría General concluye que los funcionarios del MAG e INTA tienen prohibido acreditarse y ejercer privadamente como certificadores de uso conforme del suelo, porque ello genera un conflicto de intereses contrario a los principios éticos de la función pública. La actividad privada coincidiría con funciones propias del órgano empleador, dando ventajas indebidas y comprometiendo la imparcialidad. Funcionarios de otros órganos sí pueden hacerlo si no hay relación directa con funciones del MAG, se hace fuera de horas laborales y no están bajo dedicación exclusiva. No es posible suspender temporalmente la dedicación exclusiva ni usar vacaciones o permisos sin goce de salario para evadir la prohibición, pues la relación laboral subsiste y se mantienen las incompatibilidades éticas.

INTA and professionals' authority in soil studies and land-use certifications under the Soil LawCompetencias del INTA y profesionales en estudios de suelos y certificaciones de uso conforme bajo la LUMCS

The Attorney General's Office analyzes whether INTA is legally authorized to conduct soil studies and issue land-use compliance certifications under the Soil Use, Management and Conservation Law (LUMCS) and its regulations, and whether INTA professionals may exercise those functions privately. It determines that the tax incentives under Articles 48 and 49 LUMCS require land studies prepared by professionals authorized by the College of Agronomists and approved by MAG/INTA. INTA, as an agricultural research body, has general authority to conduct soil studies, but for tax purposes under Article 46 LUMCS, it must contract such professionals. Regarding certification under Article 47, the authority belongs to the same professionals; INTA may provide the service through external contracting. Professionals working for INTA must dedicate themselves exclusively to their functions, with a prohibition on private practice, to avoid conflicts of interest. Finally, forestry science graduates registered with the College are qualified to conduct soil studies and certifications in general, not only on forest lands.La Procuraduría General analiza si el INTA está legalmente autorizado para realizar estudios de suelos y emitir certificaciones de uso conforme según la Ley de Uso, Manejo y Conservación de Suelos (LUMCS) y su reglamento, y si los profesionales del INTA pueden ejercer privadamente dichas funciones. Determina que los incentivos fiscales de los artículos 48 y 49 LUMCS exigen estudios de tierras elaborados por profesionales autorizados por el Colegio de Ingenieros Agrónomos y aprobados por el MAG/INTA. El INTA, como órgano de investigación agropecuaria, tiene competencia genérica para realizar estudios de suelos, pero para los fines tributarios del artículo 46 LUMCS debe contratar a dichos profesionales. Respecto a la certificación del artículo 47, la titularidad recae en los mismos profesionales; el INTA puede prestar el servicio mediante contratación externa. Los profesionales que trabajen para el INTA deben dedicarse exclusivamente a sus funciones, con prohibición de ejercer privadamente, para evitar conflictos de interés. Finalmente, los bachilleres en ciencias forestales incorporados al Colegio están habilitados para realizar estudios de suelos y certificaciones en general, no solo en terrenos forestales.

Prior environmental impact assessment for agricultural burningEvaluación de impacto ambiental previa para quemas agrícolas

The Attorney General's Office issues a non-binding legal opinion on legislative bill 22.906, which reforms the Soil Use, Management and Conservation Law (7779) and the Law on Dividing Fences and Burning (121), to require a prior environmental impact assessment (EIA) for agricultural burning. It concludes that requiring a prior EIA is a constitutional and legal obligation, stemming from Article 50 of the Constitution and Article 17 of the Environmental Law, because agricultural burning causes serious harm to the environment and health. It recommends that the EIA be required for all agricultural burning, not just for crops already requiring an EIA, and that the sanctioning body and procedure be specified. It also suggests requiring a technical opinion from SINAC in all cases and eliminating the possibility of granting a permit without that opinion, given that positive silence does not apply in environmental matters.La Procuraduría General de la República emite opinión jurídica no vinculante sobre el proyecto de ley 22.906, que reforma la Ley de Uso, Manejo y Conservación de Suelos (7779) y la Ley de Cercas Divisorias y Quemas (121), para exigir evaluación de impacto ambiental previa a las quemas agrícolas. Concluye que la exigencia de una EIA previa es una obligación constitucional y legal, derivada del artículo 50 de la Constitución y del artículo 17 de la Ley Orgánica del Ambiente, pues las quemas agrícolas generan graves afectaciones al ambiente y la salud. Recomienda que la evaluación se exija para todas las quemas agrícolas, no solo para cultivos que ya requieren EIA, y que se especifiquen el ente sancionador y el procedimiento. También sugiere exigir criterio técnico del SINAC en todos los casos y eliminar la posibilidad de otorgar permiso sin ese criterio, dado que no opera el silencio positivo en materia ambiental.
