Anuló las resoluciones que habían declarado prescrita la acción penal y ordenó reenviar la causa al Tribunal Penal de Puntarenas para continuar el proceso.

Además, la sentencia de juicio había descartado el cambio de uso del suelo y el aprovechamiento ilegal de productos forestales. Ante la falta de tipicidad de la conducta, el Tribunal acogió el recurso y absolvió al imputado de toda responsabilidad.

Ordenó examinar nuevamente absoluciones por legitimación de capitales y asociación ilícita, además del comiso de dos vehículos. Los restantes motivos fueron rechazados y la sentencia permaneció incólume en lo demás.
