La Sala ordenó al secretario general de SETENA, o a quien ocupe el cargo, adoptar inmediatamente las medidas necesarias para cumplir la obligación legal de remisión. También condenó al Estado al pago de costas, daños y perjuicios. Tres integrantes salvaron el voto: estimaron que no existía una lesión concreta de derechos fundamentales o que la controversia debía resolverse en la jurisdicción contencioso-administrativa.

The Constitutional Chamber denied the challenge to Executive Decree No. 40075-MICITT-S-MEIC-MINAE-MOPT and SETENA Agreement ACP-30-2017, which reserve environmental impact assessment for telecommunications towers and, under the current technical criterion, exclude poles. It held that the amendment neither eliminated nor weakened SETENA’s authority, but left that technical agency to determine which infrastructure must obtain environmental viability according to its impacts. The Chamber accepted the distinction between towers and poles: although both support equipment, their dimensions, foundations, loads, and environmental effects differ. According to SETENA, pole installation is an activity with very low potential environmental impact and remains subject to municipal and sector-specific controls. Towers do require environmental assessment and may be subject to more specific instruments and stricter requirements when located in environmentally fragile areas. The Chamber found neither environmental regression nor a lack of technical support and characterized the remaining objections as matters of ordinary legality outside constitutional review.La Sala Constitucional rechazó la acción dirigida contra el Decreto Ejecutivo n.º 40075-MICITT-S-MEIC-MINAE-MOPT y el acuerdo ACP-30-2017-SETENA, que reservan la evaluación de impacto ambiental para las torres de telecomunicaciones y excluyen, según el criterio técnico vigente, los postes. Determinó que la reforma no eliminó ni debilitó las competencias de SETENA, sino que dejó a ese órgano técnico decidir cuáles infraestructuras deben tramitar viabilidad ambiental conforme a su impacto. La Sala aceptó la diferenciación entre torres y postes: aunque ambos sostienen equipos, sus dimensiones, cimentaciones, cargas y efectos ambientales son distintos. Según SETENA, instalar postes constituye una actividad de muy bajo impacto ambiental potencial y permanece sujeta a controles municipales y sectoriales. Las torres sí requieren evaluación ambiental y, cuando se ubiquen en áreas ambientalmente frágiles, pueden quedar sometidas a instrumentos y requisitos más rigurosos. La Sala no constató regresión ambiental ni falta de sustento técnico y calificó las restantes objeciones como asuntos de legalidad ordinaria.

The Constitutional Chamber denied the amparo brought on behalf of the Los Robles rural water association concerning alleged threats to the environment, springs, and water supply caused by earthworks, tree removal, and agricultural activities by Agrícola Pascale S.A. within the El Chayote Protected Zone. The Court found that the Municipality of Naranjo, SINAC, and SETENA had addressed the complaints through inspections, work closures and suspensions, interagency coordination, environmental review, and referral of relevant facts to the Public Prosecutor’s Office. It also found no harmful act or omission attributable to SENARA or MINAE. Accordingly, the Court did not establish any openly arbitrary, disproportionate, delayed, or negligent administrative conduct violating fundamental rights. It nevertheless instructed the respondent authorities to coordinate and undertake every action within their jurisdiction so that future activities on the property comply with the preventive and precautionary principles and safeguard the right to a healthy and ecologically balanced environment.La Sala Constitucional declaró sin lugar el amparo promovido a favor de la ASADA Los Robles por presuntas amenazas al ambiente, las nacientes y el abastecimiento de agua derivadas de movimientos de tierra, corta de árboles y actividades agrícolas de Agrícola Pascale S. A. dentro de la Zona Protectora El Chayote. El Tribunal constató que la Municipalidad de Naranjo, el SINAC y la SETENA habían atendido las denuncias mediante inspecciones, clausuras y paralización de obras, coordinación interinstitucional, evaluación ambiental y remisión de hechos al Ministerio Público. Tampoco comprobó una acción u omisión lesiva atribuible al SENARA o al MINAE. Por ello, no estimó demostrada una conducta administrativa abiertamente arbitraria, desproporcionada, tardía o negligente que lesionara derechos fundamentales. No obstante, advirtió a las autoridades que deben coordinar y ejercer todas sus competencias para garantizar que las actividades futuras en la propiedad respeten los principios preventivo y precautorio y el derecho a un ambiente sano y ecológicamente equilibrado.

Environmental registration for social-family aquaculture, an affidavit of environmental commitments for small-scale projects, an environmental management forecast-plan for medium-scale projects, and an EsIA for large-scale projects satisfy that obligation when assigned according to potential impact. The classification rests on objective criteria such as concession area, annual production, and cultivated species. Minimum separation distances, production limits, water-use concessions, and institutional authorizations also restrict the activity. Accordingly, the decree neither violates the right to a healthy environment nor exceeds the Executive Branch’s regulatory authority. El registro ambiental para acuicultura social-familiar, la declaración jurada de compromisos ambientales para pequeña escala, el pronóstico-plan de gestión ambiental para mediana escala y el EsIA para gran escala satisfacen esa obligación cuando se asignan conforme al impacto potencial. La clasificación se apoya en criterios objetivos como el área concesionada, la producción anual y la especie cultivada. También existen distancias mínimas, límites productivos, concesiones de agua y autorizaciones institucionales que restringen la actividad. Por ello, el decreto no vulnera el derecho al ambiente ni excede la potestad reglamentaria.

By majority vote, the Constitutional Chamber denied the constitutional challenge to the phrase classifying only an alteration of “high Environmental Impact Significance” as environmental damage under the General Regulation on Environmental Impact Assessment Procedures. The challenged regulatory provision therefore remained in place. The claim argued that the definition unjustifiably excluded impacts of low or medium significance and restricted reparation, sanctioning proceedings, and enforcement of environmental guarantees, contrary to Article 50 of the Constitution and the principles of reparation, prevention, non-regression, progressivity, statutory reservation, and environmental objectification. The judgment records a significant division: Justices Cruz Castro, Rueda Leal, and Garita Navarro dissented and would have declared the phrase “of high significance” unconstitutional because, in their view, it lacked technical and scientific support, narrowed the statutory concept of environmental damage through subordinate regulation, and could leave certain harm without administrative sanctions or reparation. La sentencia registra una división relevante: los magistrados Cruz Castro, Rueda Leal y Garita Navarro salvaron el voto y habrían declarado inconstitucional la frase “de alta significancia”, al considerar que carecía de sustento técnico y científico, restringía reglamentariamente el concepto legal de daño ambiental y podía dejar daños sin consecuencias reparadoras o sancionatorias. The Chamber acknowledged that it could neither decide directly whether the pesticide should be banned nor choose among conflicting scientific assessments, since those determinations belong to the competent technical authorities. It nevertheless held that administrative delay, in the face of reasonable doubt about possible environmental harm, warranted judicial intervention to enforce the preventive and precautionary principles and protect the right to a healthy environment. The Chamber ordered the Ministry of Agriculture and Livestock, Ministry of Health, Ministry of Environment and Energy, SENASA, and State Phytosanitary Service to ensure that the interinstitutional team completed the required studies and issued its final report within three months. If serious harm or impairment of pollination was established, the report had to specify appropriate corrective measures and a timetable for implementing them.La Sala Constitucional declaró con lugar el amparo promovido por la defensora de los Habitantes ante la falta de una determinación definitiva sobre la regulación del Fipronil, pese a los criterios técnicos que advertían riesgos serios e inaceptables para las abejas y otros insectos polinizadores. Sin embargo, consideró que la demora administrativa, frente a una duda razonable sobre posibles daños ambientales, justificaba su intervención para asegurar la aplicación de los principios preventivo y precautorio y la tutela del derecho a un ambiente sano. Ordenó al MAG, al Ministerio de Salud, al MINAE, al SENASA y al Servicio Fitosanitario del Estado procurar que el equipo interinstitucional concluyera en tres meses los estudios y rindiera un informe final. Si se comprobaban daños graves o afectación de la polinización, el informe debía proponer medidas correctivas y su plazo de ejecución.

The Constitutional Chamber granted the challenge to Executive Decree No. 38334, which approved the 2013–2030 GAM Plan, because this land-use planning instrument relied on the environmental approval granted to the 2009 PRUGAM proposal without undergoing an assessment corresponding to the plan ultimately adopted. Substantial technical differences between the two plans prevented the government from automatically transferring that approval and made the decree incompatible with both the principle prohibiting singular derogation of regulations and the constitutional right to a healthy and ecologically balanced environment under Article 50. The judgment reaffirms that urban planning must incorporate the environmental variable beforehand through a strategic environmental assessment or another adequate technical study reviewed by SETENA. Although the Chamber declared the decree unconstitutional, it tailored the judgment’s effects to prevent a planning vacuum harmful to the environment, temporarily preserving the decree for thirty-six months so the authorities could issue replacement regulations supported by an appropriate environmental evaluation.La Sala Constitucional declaró con lugar la acción contra el Decreto Ejecutivo n.° 38334, que aprobó el Plan GAM 2013-2030, porque este instrumento de ordenamiento territorial utilizó la viabilidad ambiental concedida al proyecto PRUGAM de 2009 sin contar con una evaluación propia que correspondiera al plan finalmente adoptado. La sentencia reafirma que la planificación urbana debe incorporar previamente la variable ambiental mediante evaluación ambiental estratégica u otro estudio técnico adecuado, sujeto al examen de SETENA. Aunque declaró inconstitucional el decreto, la Sala dimensionó los efectos para evitar un vacío perjudicial en la planificación territorial y mantuvo temporalmente su vigencia durante treinta y seis meses, plazo destinado a emitir una nueva normativa ambientalmente evaluada.

The Constitutional Chamber rejected the challenge to several amendments to the General Regulation on Environmental Impact Assessment Procedures. It held that defining very-low-potential-impact activities without a predetermined list does not violate the Constitution and that operating activities may be exempted from a new EIA when renewing permits because they remain subject to other environmental controls. It also upheld the geographic registration of projects processed through the D2 form, reasoning that constitutional jurisdiction cannot require SETENA to use a particular mapping instrument. Extending the validity of environmental approval from two to five years likewise does not, by itself, amount to environmental regression, especially because the challengers supplied no technical or scientific evidence of diminished protection. Finally, although the new thresholds for earthworks and buildings reduced previously applicable controls, that change is not automatically unconstitutional. The technical and scientific basis for those thresholds must instead be examined through ordinary judicial proceedings.La Sala Constitucional rechazó la acción contra varias reformas al Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental. Finalmente, aunque los nuevos umbrales para movimientos de tierra y edificaciones redujeron controles anteriores, esa modificación no es automáticamente inconstitucional; el examen de su fundamento técnico y científico corresponde a la vía ordinaria.

Although the Ministry of Health reported that the observed waste handling was safe and caused no proven health or environmental harm, the Chamber held that the Municipality violated the preventive principle and failed to ensure proper interagency coordination. It clarified that an emergency may justify temporarily dispensing with certain environmental studies only for the period reasonably necessary to address the critical phase; an indefinitely extended operation remains subject to ordinary environmental controls. The Chamber therefore partially granted the amparo and ordered the mayor to submit an environmental-approval application for the operating station within eight business days. It found no constitutional violation concerning the planned municipal transfer plant because its D1 proceeding remained under SETENA review, and it absolved SETENA of responsibility because that agency had not been informed about the existing station.La Sala Constitucional examinó la operación prolongada de una estación temporal de transferencia de residuos sólidos ordinarios en Pérez Zeledón, la cual carecía tanto de viabilidad ambiental de SETENA como de permiso sanitario de funcionamiento. Aunque el Ministerio de Salud informó que el manejo observado era inocuo y no generaba afectación sanitaria o ambiental comprobada, la Sala concluyó que la Municipalidad vulneró el principio preventivo y actuó sin la debida coordinación institucional. Precisó que una emergencia puede justificar provisionalmente prescindir de ciertos estudios ambientales únicamente durante el período razonablemente necesario para atender su fase crítica; una operación indefinida exige cumplir los controles ambientales ordinarios. Por ello declaró parcialmente con lugar el amparo y ordenó a la alcaldesa presentar, en ocho días hábiles, la solicitud de viabilidad ambiental para la estación que ya operaba. No encontró infracción respecto de la futura planta municipal, porque su expediente D1 estaba bajo estudio de SETENA, ni atribuyó responsabilidad a SETENA, que desconocía la estación existente.

Los magistrados Armijo y Cruz salvaron el voto y habrían acogido la acción; Cruz además cuestionó que particulares con interés directo controlaran la preparación del plan.

The Constitutional Chamber granted the challenge to provisions of the Fisheries and Aquaculture Law permitting semi-industrial shrimp fishing with trawl nets. It held that this technique, while no scientifically validated devices significantly reduce incidental catch, harms hydrobiological resources, marine ecosystems, food security, and the natural heritage protected by the Constitution. The judgment invalidated the references to shrimp trawling in Articles 2 and 43 and the category A and B licenses established by Article 47. It prohibited INCOPESCA from issuing new licenses, renewing expired licenses, or reactivating inactive ones. To protect rights acquired in good faith, existing licenses remained valid until their respective expiration dates, subject to compliance with the legal system and use of the most environmentally friendly available technologies. Future legislation could reinstate the categories only if supported by scientific and technological evidence and if it expressly required devices capable of significantly reducing incidental catch.La Sala Constitucional declaró con lugar la acción contra las disposiciones de la Ley de Pesca y Acuicultura que permitían la pesca semiindustrial de camarón mediante redes de arrastre. La sentencia anuló la referencia al camarón con red de arrastre de los artículos 2 y 43, así como las categorías de licencia A y B del artículo 47. Prohibió a INCOPESCA conceder licencias nuevas, renovar las vencidas o reactivar las inactivas. Por respeto a los derechos adquiridos de buena fe, mantuvo las licencias vigentes hasta su vencimiento, sujetas al ordenamiento y a las tecnologías ambientalmente más amigables disponibles. Una futura ley podría restablecer las categorías únicamente con respaldo científico y medidas eficaces para reducir la captura incidental.

The remainder of the challenge was denied. Determinó que esa condición excluía indebidamente zonas que, por mandato legal, ya integran dicho patrimonio y deben recibir protección administrativa. Los humedales ubicados en terrenos estatales, así como los manglares, bosques salados y esteros pertenecientes a la zona pública marítimo-terrestre, no necesitan una declaratoria adicional para quedar sometidos al régimen protector. La Sala anuló parcialmente los artículos 2 y 3, eliminando las frases que exigían aquella declaratoria, y mantuvo la administración estatal de los humedales marinos mediante el MINAET y el SINAC. La sentencia preservó el resto del decreto y otorgó efectos declarativos y retroactivos a la anulación, sin afectar derechos adquiridos de buena fe ni situaciones jurídicas consolidadas.

It rejected the remaining claims because the technical studies in the record did not establish the alleged environmental violations and because certain technical or ordinary-legality disputes belonged in other proceedings. Justices Armijo and Cruz dissented. It determined that such an assessment is the appropriate technical instrument for applying the precautionary principle, identifying waste-management risks in advance, and protecting the right to a healthy and ecologically balanced environment under Article 50 of the Constitution. Subsequent oversight by the Ministry of Health, SETENA, and the relevant municipality cannot replace preventive assessment because environmental harm may already be irreversible by that stage. The Chamber also rejected municipal financial constraints as justification for reducing the protection of fundamental rights. En consecuencia, anuló las excepciones introducidas por los decretos ejecutivos 27.443-S y 25.128-S, con efectos declarativos y retroactivos desde sus respectivas fechas de vigencia, sin perjuicio de los derechos adquiridos de buena fe.

Esa aprobación tampoco otorgó viabilidad ambiental para las actividades de investigación de campo. En consecuencia, la negativa estatal a suscribir el contrato respondió a razones técnico-jurídicas y al principio de legalidad, no a motivos políticos. Se acogió la excepción de falta de derecho, se declaró sin lugar la demanda y se impusieron ambas costas a la actora.

La decisión mantuvo la medida cautelar hasta adquirir firmeza, impuso las costas a los demandados y dispuso remitir antecedentes a autoridades administrativas, penales, fiscalizadoras y profesionales para investigar posibles responsabilidades relacionadas con la aprobación y ejecución del proyecto.

Although the company had attempted to satisfy the requirement and SETENA declined to rule because operations had already begun, that refusal did not authorize the Municipal Council to waive the technical assessment required by Article 17 of the Organic Environmental Law. Under Article 50 of the Constitution, local governments must guarantee, defend, and preserve the environment. Because fuel storage poses risks to both the public and the environment, uncertainty about the activity’s safety required application of the precautionary principle. The company bore the burden of proving that its operations would not harm public health or the environment. Consequently, ordering issuance of the permit without supporting technical studies violated the principle of legality as well as binding rules of science and technology.El Tribunal acogió el veto del alcalde de Escazú contra los acuerdos municipales que ordenaban conceder a Tractores Escazú S.A. una licencia para operar dos tanques de almacenamiento de diésel sin viabilidad ambiental de SETENA. Aunque la empresa había procurado cumplir el requisito y SETENA se negó a pronunciarse porque la actividad ya había iniciado, esa negativa no facultaba al Concejo Municipal para dispensar la evaluación técnica exigida por el artículo 17 de la Ley Orgánica del Ambiente. Conforme al artículo 50 constitucional, el gobierno local debe garantizar, defender y preservar el ambiente. Dado el peligro que el almacenamiento de combustible representa para la población y el entorno, la falta de certeza sobre su inocuidad obliga a aplicar el principio precautorio. La carga de demostrar que la actividad no afectará la salud ni el ambiente corresponde a la empresa. Por ello, ordenar la licencia sin estudios técnicos contradijo el bloque de legalidad y las reglas de la ciencia y la técnica.

En consecuencia, suspendió la ejecución del acuerdo hasta resolver las objeciones formuladas contra el plan regulador.

En la ponderación de intereses, el tribunal concluye que prevalece el interés público en la regulación y licenciamiento de la actividad pesquera sobre una prohibición absoluta, dado el impacto económico sobre comunidades costeras y la falta de prueba científica que justifique la restricción total. Se revoca la medida provisionalísima y se rechaza la cautelar en todos sus extremos.

The Administrative Litigation Court granted the precautionary measure requested by the State against Unión Distribuidora Ferarosse S.A., finding a likelihood of success, danger in delay, and a prevailing public environmental interest. It held that SINAC technical report SINAC-ACOPAC-CH-00034-2023 was admissible because it did not disclose negotiations, proposals, or partial agreements protected by conciliation confidentiality. Other studies also provided preliminary support for the presence of mangrove areas within the properties. The Court reasoned that an agricultural sustainability certification neither authorizes nor cures a possible encroachment upon a wetland belonging to the State Natural Heritage. It therefore ordered the immediate suspension of all unauthorized productive, agricultural, livestock, or other activities within the area identified as mangrove. The company must also provide coordinated access to SINAC officials so they can verify compliance and plan restoration and recovery measures. The Court denied the company’s request that the State post security and made no special award of costs.El Tribunal Contencioso Administrativo acogió la medida cautelar solicitada por el Estado contra Unión Distribuidora Ferarosse S.A. al estimar acreditadas la apariencia de buen derecho, el peligro en la demora y la prevalencia del interés público ambiental. Consideró admisible el informe SINAC-ACOPAC-CH-00034-2023 porque su contenido técnico no revelaba conversaciones, propuestas ni acuerdos protegidos por la confidencialidad de la conciliación. Otros estudios también respaldaban preliminarmente la existencia de áreas de manglar dentro de los inmuebles. El Tribunal razonó que una certificación de sostenibilidad agrícola no autoriza ni subsana la posible invasión de un humedal perteneciente al Patrimonio Natural del Estado. En consecuencia, ordenó suspender inmediatamente toda actividad productiva, agrícola, ganadera o de otra índole no autorizada dentro del área delimitada como manglar. Asimismo, dispuso que la empresa permita el ingreso coordinado de funcionarios del SINAC para verificar el cumplimiento y programar acciones de restauración y recuperación. Rechazó la contracautela y resolvió sin especial condena en costas.

This regulation establishes the conditions, criteria and procedures for the payment of privately owned lands located within Manuel Antonio National Park and other protected wild areas of the Aguirre, Parrita and Los Santos subregions. It is governed by the Organic Environmental Law, the Expropriation Law and the specific park law. For a property to be acquired, it must meet requirements such as having an official protected area declaration, updated appraisals, budget availability from the trust and board approval. A file is compiled with registry, cadastral and legal representation documents, plus a technical report verifying location, absence of invasions and importance for the consolidation of the protected area. If the owner does not accept the administrative appraisal, MINAE is notified to initiate the expropriation process. Criteria such as prevention, precaution, public environmental interest and integration are defined, along with maximum deadlines to authorize payment and register the lands in favor of the State.Este reglamento establece las condiciones, criterios y procedimientos para el pago de tierras de propiedad privada ubicadas dentro del Parque Nacional Manuel Antonio y otras áreas silvestres protegidas de las Subregiones Aguirre, Parrita y Los Santos. Se rige por la Ley Orgánica del Ambiente, la Ley de Expropiaciones y la ley específica del parque. Para que una propiedad sea adquirida debe cumplir requisitos como contar con declaratoria oficial de área protegida, avalúos actualizados, disponibilidad presupuestaria del fideicomiso y acuerdo de la junta directiva. Se integra un expediente con documentos registrales, catastrales y de representación legal, además de un informe técnico que verifique la ubicación, ausencia de invasiones e importancia para la consolidación del área protegida. Si el propietario no acepta el avalúo administrativo, se comunica al MINAE para iniciar el proceso de expropiación. Se definen criterios como el preventivo, precautorio, de interés público ambiental y de integración, y plazos máximos para autorizar el pago e inscribir las tierras a favor del Estado.
