Ordenó realizar un informe interinstitucional sobre la situación extractiva, revisar los instrumentos de evaluación de impacto ambiental incorporando análisis de efectos acumulativos, emitir una valoración técnica sobre biodiversidad y humedales, y que las municipalidades ejerzan control local efectivo. Se declara sin lugar respecto a la CNE. El vicio constitucional fue la tutela pública insuficiente, en violación del artículo 50 de la Constitución y estándares interamericanos.

Solicitó la suspensión de las actividades mecanizadas, estudios técnicos, y un régimen diferenciado para la minería artesanal. Las autoridades recurridas negaron las violaciones, argumentando falta de competencia o que ejercían sus funciones adecuadamente. La Sala Constitucional analizó las competencias de cada entidad, los principios de razonabilidad, proporcionalidad y precautorio, y el carácter de patrimonio cultural del boyeo artesanal. Concluyó que no se demostró una violación actual de derechos fundamentales, pero ordenó a las instituciones coordinar esfuerzos para proteger el ambiente, salvaguardar la actividad artesanal y garantizar estudios técnicos sobre los impactos de la extracción, sin conceder la medida cautelar de suspensión inmediata.

Además, interpretó su último párrafo para precisar que la potestad de la Dirección de Agua de autorizar obras no desplaza las competencias de la SETENA ni elimina la evaluación de impacto ambiental previa cuando resulte técnicamente necesaria según la obra o actividad. Tres magistrados salvaron parcialmente el voto: consideraron constitucionales las disposiciones anuladas si la clasificación de bajo impacto se fundamentaba previamente en un estudio técnico.

Claims regarding citizen participation, the alleged privatization of beach access, and other points were dismissed. Aunque la municipalidad sostiene que no autorizó tala alguna y suspendió el convenio, la Sala acredita que los árboles fueron efectivamente marcados y que ni la municipalidad ni el SINAC emprendieron una investigación oficiosa para identificar responsables o causas. La ausencia de acciones concretas más allá de remover las marcas constituye una omisión lesiva del derecho a un ambiente sano. Aplicando los principios precautorio, preventivo, pro natura y de no regresión, el Tribunal ordena iniciar de inmediato un procedimiento para esclarecer los hechos y dictar medidas precautorias que impidan cualquier tala ilegítima. Declara sin lugar el reclamo sobre participación ciudadana, la supuesta privatización del acceso a playa y otros extremos. Se imponen costas a las entidades recurridas.

La Sala anuló el decreto y ordenó a la Procuraduría General de la República ejercer, dentro de doce meses, las acciones necesarias para defender el patrimonio público y restituir la zona protectora a su extensión anterior. La decisión dejó abierta la posible responsabilidad patrimonial del Estado. Un voto particular sostuvo que la manifiesta inconstitucionalidad del decreto impedía reconocer derechos adquiridos de buena fe derivados de su vigencia.

Por ello, su prestación por particulares debe adjudicarse mediante un procedimiento de contratación pública que respete el artículo 182 constitucional y los principios de publicidad, igualdad, libre concurrencia, transparencia y eficiencia. La sentencia dispuso que las referencias legales a “autorización”, “autorizaciones”, “autorizada” y “autorizadas” se entiendan como “adjudicación”, “adjudicaciones”, “adjudicada” y “adjudicadas”. La inspección continúa siendo obligatoria y el MOPT conserva su competencia y responsabilidad sobre el servicio. La decisión contiene voto salvado por razones de legitimación y admisibilidad.

The Constitutional Chamber grants an unconstitutionality action against phrases in Executive Decree 42747-MINAE that conditioned the import, transport, distribution and marketing of liquefied natural gas (LNG) exclusively to the substitution of bunker fuel in industrial and commercial use. The Chamber finds that this restriction violates the principles of reasonableness, proportionality, objectivation of environmental protection (lack of technical studies), non-regression, precaution, prevention and pro natura, by limiting the use of a cleaner transition fuel solely to replace bunker, even though Decree 37413-MINAET of 2012 had declared the import, use and distribution of LNG as a public-interest activity as a transition fuel toward cleaner options in general. Furthermore, for the self-consumption regime, the restriction imposed by executive decree breaches the reserve of law and freedom of enterprise. The Chamber clarifies that LNG regulation under a public-service regime is not unconstitutional, since that activity is reserved to the State and subject to stricter regulation.La Sala Constitucional declara con lugar una acción de inconstitucionalidad contra frases del Decreto Ejecutivo 42747-MINAE que condicionaban la importación, transporte, distribución y comercialización de gas natural licuado (GNL) exclusivamente a la sustitución del búnker en uso industrial y comercial. La Sala considera que dicha restricción vulnera los principios de razonabilidad, proporcionalidad, objetivación de la tutela ambiental (falta de estudios técnicos), no regresividad, precautorio, preventivo y pro natura, al limitar el uso de un combustible de transición más limpio únicamente para reemplazar el búnker, pese a que el Decreto 37413-MINAET de 2012 había declarado de interés público la importación, uso y distribución del GNL como combustible de transición hacia opciones más limpias en general. Además, tratándose del régimen de autoconsumo, la restricción impuesta por decreto ejecutivo vulnera la reserva de ley y la libertad de empresa. La Sala aclara que la regulación del GNL en régimen de servicio público no resulta inconstitucional, dado que esa actividad está reservada al Estado y sujeta a una regulación más intensa.

The Constitutional Chamber denied the constitutional challenge brought by three fishing associations against Executive Decree No. 43368-MINAE, which expanded Cocos Island National Park and created a marine management area. It held that describing the boundaries through UTM Zone 16 coordinates did not create legal uncertainty because affordable equipment capable of reading those coordinates exists. The Chamber also found no violation of legitimate expectations: fishing permit holders know that the sea is public-domain property and that the State may create or expand protected wildlife areas to safeguard the environmental right guaranteed by Article 50 of the Constitution. Moreover, the decree neither revoked licenses, concessions, or permits nor made all fishing activity impossible. The Chamber rejected the remaining claims concerning freedom of enterprise, employment, equality, and other rights because they lacked clear, precise, and concrete supporting arguments. También descartó una lesión a la confianza legítima: quienes reciben permisos de pesca conocen el carácter demanial del mar y la potestad estatal de crear o ampliar áreas silvestres protegidas para tutelar el derecho al ambiente del artículo 50 constitucional. Además, el decreto no eliminó licencias, concesiones o permisos ni imposibilitó toda actividad pesquera. La Sala desestimó los restantes reclamos sobre libertad de empresa, trabajo, igualdad y otros derechos porque carecían de argumentos claros, precisos y concretos. En consecuencia, concluyó que el decreto no contravenía el Derecho de la Constitución en los términos alegados.

The earlier judgment’s decisive rationale was to prevent the Administration from setting attendance arbitrarily—as it had when allowing 3,000 entries without technical justification—and to require visitor limits to rest on appropriate scientific tools. In this case, the Intervention Commission reapplied the Technical Tool for Managing Visitor Flows and considered improvements to infrastructure, equipment, services, and staffing. Because that analysis concluded that current park conditions could support up to 1,568 visitors per day, the Chamber found that the increase was technically justified rather than an arbitrary administrative decision and therefore did not establish a violation of the constitutional right to a healthy environment.La Sala Constitucional rechazó el recurso de amparo que cuestionaba el aumento del aforo diario del Parque Nacional Manuel Antonio de 1120 a 1568 visitantes. Aclaró que la sentencia 2023011233 no fijó un límite definitivo e inamovible de 1120 personas, sino que ordenó aplicar temporalmente la capacidad determinada en diciembre de 2022 mientras un nuevo estudio técnico no estableciera otra cifra. La razón decisoria de aquel fallo fue impedir que la Administración definiera arbitrariamente la visitación, como había ocurrido al autorizar 3000 ingresos sin respaldo técnico, y exigir que el aforo se sustentara en herramientas científicas adecuadas. En el caso examinado, la Comisión Interventora utilizó nuevamente la Herramienta Técnica para el Manejo de los Flujos de Visitación y consideró mejoras de infraestructura, equipo, servicios y recursos humanos. Como ese análisis concluyó que las condiciones actuales permitían recibir hasta 1568 personas diariamente, la Sala estimó que el aumento tenía justificación técnica y no lesionaba el derecho constitucional a un ambiente sano.

It reaffirmed the primacy of ecosystem conservation over public enjoyment and the need for a balance between visitation and preservation under the Park’s Public Use Regulation.La Sala Constitucional declaró con lugar un recurso de amparo interpuesto contra el Sistema Nacional de Áreas de Conservación (SINAC) y el Área de Conservación Pacífico Central (ACOPAC) por haber incrementado la visitación diaria del Parque Nacional Manuel Antonio (PNMA) de 2000 a 3000 personas sin respaldo en las herramientas técnicas exigidas por la normativa. La Sala constató que la visitación alcanzaba un 267.9% de la capacidad instalada, muy por encima de la capacidad de carga de 1120 visitantes diarios calculada según el modelo de flujo de diciembre de 2022. Con base en el principio de objetivación de la tutela ambiental, que exige fundamentar las decisiones administrativas en estudios técnicos, y el principio preventivo, que obliga a actuar ante riesgos claros de daño, la Sala ordenó reducir de inmediato la visitación a 1120 personas diarias. Asimismo, reconoció la prioridad de la conservación del ecosistema sobre el disfrute público y la necesidad de un equilibrio entre visitación y preservación conforme al Reglamento de Uso Público del parque.

The Costa Rican Organic Agriculture Movement Association challenged Executive Decree No. 41481-MAG—which reforms the regulation for updating pesticide registration files—as violating Articles 21 and 50 of the Constitution and the precautionary principle. It held that the decree does not govern the registration of new pesticides but rather updates the information on already registered and marketed products, aiming to organize the registration system, end indefinite validity periods, and obtain confidential chemical data on impurities. It rejected the argument that excluding the Health and Environment Ministries from signing the decree or from the updating process amounts to a constitutional injury, since the Phytosanitary Protection Law vests registration authority in the State Phytosanitary Service (SFE), without prejudice to those ministries' broad oversight and precautionary powers. It found no flaws in timeframes, requirements, or reliance on referenced data, referring on that last point to ruling No. 2022-26651, which upheld the use of information from other authorities under international standards. It affirmed that the precautionary principle requires authorities to act upon certain, real, and imminent risks, even regarding registered products.La Asociación para el Movimiento de Agricultura Orgánica Costarricense impugnó el Decreto Ejecutivo n.°41481-MAG, que reforma el reglamento de actualización de expedientes de registro de plaguicidas, alegando violación a los artículos 21 y 50 de la Constitución Política y al principio precautorio. La Sala Constitucional desestimó la acción. Consideró que el decreto no regula el registro de nuevos plaguicidas, sino la actualización de la información de productos ya registrados y comercializados, para ordenar el sistema de registros, acabar con la vigencia indefinida y obtener información química confidencial sobre impurezas. Rechazó que la exclusión de los Ministerios de Salud y Ambiente en la suscripción o en el trámite de actualización configure una lesión constitucional, pues la Ley de Protección Fitosanitaria concentró la competencia de inscripción en el SFE, sin perjuicio de las amplias facultades de esos ministerios para fiscalizar y adoptar medidas precautorias. Tampoco encontró vicios en los plazos, requisitos o uso de información referenciada, remitiéndose en este último punto a la sentencia n.°2022-26651 que avaló el uso de información de otras autoridades conforme a estándares internacionales. Afirmó que el principio precautorio obliga a las autoridades a actuar ante riesgos ciertos, reales e inminentes, incluso sobre productos registrados.

Articles 3 and 24 also contravened Article 45 because they affected private-property rights and the inviolability of private assets. También descartó que el régimen de incentivos de los artículos 9 a 14 lesionara los principios de seguridad jurídica, claridad normativa, razonabilidad técnica o equilibrio fiscal. Sin embargo, por unanimidad encontró defectos puntuales: el artículo 18 infringía el derecho a un ambiente sano del artículo 50 constitucional al permitir que el jerarca del MINAE definiera el trámite de viabilidad ambiental y al imponer un plazo máximo de sesenta días para resolver la evaluación o permiso ambiental; además, los artículos 3 y 24 vulneraban la propiedad privada y la intangibilidad del patrimonio privado, protegidas por el artículo 45. Los restantes cuestionamientos de fondo fueron descartados.

Finally, it held that Transitional Provision II did not order a plan amendment but granted a deadline for the municipality to incorporate donated lands into its regulatory plan, a task already within its purview. Los consultantes alegaron violación del principio de objetivación de la tutela ambiental por falta de estudios científicos suficientes, ausencia de compensación, y vulneración de la autonomía municipal al ordenar al gobierno local modificar su plan regulador. La Sala desestimó todos los cuestionamientos. Consideró que el estudio técnico aportado al expediente legislativo conciliaba adecuadamente la realidad material del área —con vocación histórica y construcciones existentes— con la declaratoria original de patrimonio natural basada solo en clasificación de suelos, no en cobertura boscosa. Descartó la necesidad de compensación pues el proyecto conserva bajo administración del SINAC los terrenos de aptitud forestal y no se identificaron áreas concretas no compensadas. La Sala encontró el proyecto conforme a la Constitución.

Claims concerning private property, the expedited legislative procedure, and legal certainty were inadmissible because standing or a prerequisite underlying case was lacking. Los alegatos relativos a propiedad privada, procedimiento legislativo abreviado y seguridad jurídica fueron inadmisibles por falta de legitimación o asunto previo. Tres magistrados disintieron: estimaron insuficientes los estudios técnicos, incierta la equivalencia ecológica de la compensación y contraria la reducción a los principios precautorio, de irreductibilidad, no regresión y objetivación de la tutela ambiental.

La Sala determinó que la omisión debilita la aplicación de los principios preventivo y precautorio al privar a los gobiernos locales de información esencial para la prevención de daños ambientales. Asimismo, vulnera el principio de coordinación interadministrativa, dado que la protección del ambiente es una tarea conjunta de todas las instituciones públicas. El tribunal acogió el recurso y ordenó a SETENA adoptar medidas concretas para garantizar el cumplimiento efectivo y oportuno de la comunicación legalmente exigida.

The Constitutional Chamber defines the principle of objectification of environmental protection as the requirement that legislative and administrative decisions on environmental matters be based on technical and scientific criteria, pursuant to Articles 16 of the General Public Administration Act and 38 of the Organic Environmental Act. This principle derives directly from the constitutional right to a healthy and ecologically balanced environment and binds state actions to the unequivocal rules of science and technology. When technical studies, such as environmental impact assessments, show objective technical criteria indicating the probability of evident environmental harm, the proposed project, work, or activity must be rejected. In case of reasonable doubt, the in dubio pro natura principle applies, which may entail adopting compensatory or precautionary measures to adequately protect the environment. It differs from the precautionary principle, as it focuses on technical substantiation as a limit to administrative discretion.La Sala Constitucional define el principio de objetivación de la tutela ambiental como la exigencia de que las decisiones legislativas y administrativas en materia ambiental se funden en criterios técnicos y científicos, según los artículos 16 de la Ley General de la Administración Pública y 38 de la Ley Orgánica del Ambiente. Este principio deriva directamente del derecho constitucional a un ambiente sano y ecológicamente equilibrado y vincula las actuaciones estatales a las reglas unívocas de la ciencia y la técnica. La Sala determinó que la restricción reglamentaria excedía lo dispuesto en la Ley de Uso, Manejo y Conservación de Suelos (N° 7779) y su reglamento ejecutivo, los cuales solo exigen que el certificado sea emitido por un profesional autorizado por el Colegio de Ingenieros Agrónomos, sin distinguir entre ingenieros agrónomos y forestales. Además, la restricción carecía de motivación técnica adecuada, violando el principio de objetivación de la tutela ambiental y los derechos fundamentales de los profesionales. La Sala también sostuvo que el reglamento impugnado era autónomo y no ejecutivo, por lo que no podía regular derechos fundamentales. Se rechazaron los argumentos sobre falta de idoneidad de los forestales y se señaló que otros usos de suelo —como charral, tacotal o zona verde— no justifican la exclusión. Se acogió parcialmente el recurso solo para anular la condenatoria en costas, manteniendo el resto del fallo.

However, the Court finds that the grounds invoked by the Mayor are non-existent: no environmental damage was proven, and the previous Mayor's decision did not reject the subsidiary claim, but rather recognized the Urban Development Department's authority to analyze it. As the challenged act lacks truthful motivation, it is vitiated by absolute nullity. The Court annuls the appealed decisions and orders the Municipality to issue the requested construction permit, maintaining the prior verification of requirements already carried out.El Tribunal Contencioso Administrativo conoce de un recurso de apelación en jerarquía impropia interpuesto por Empresas Berthier EBI de Costa Rica S.A. contra la resolución de la Alcaldía Municipal de Montes de Oro que anuló el permiso de construcción condicionado y suspensorio otorgado por el Departamento de Desarrollo Urbano para la edificación del "Parque de Tecnología Ambiental Galagarza". La Alcaldía había anulado dicho permiso argumentando daño ambiental y que el Alcalde anterior ya había rechazado otorgar un permiso condicionado. Sin embargo, el Tribunal determina que los motivos invocados por la Alcaldía son inexistentes: no se demostró daño ambiental alguno, y la resolución anterior del Alcalde no rechazó la pretensión subsidiaria, sino que reconoció la competencia del Departamento de Desarrollo Urbano para analizarla. Al carecer el acto impugnado de motivación veraz, incurre en un vicio de nulidad absoluta. El Tribunal anula las resoluciones recurridas y ordena a la Municipalidad emitir el permiso de construcción solicitado, manteniendo la verificación previa de requisitos ya realizada.

The Administrative Litigation Court dismissed every claim brought by Eco Proyecciones del Nuevo Milenio S.A., which sought to annul several SETENA, Geology and Mines Directorate, and MINAE decisions, restore environmental approval and the concession to operate the Tajo Asunción quarry, and recover damages. The Court held that environmental approval had been granted subject to a condition precedent: filing, within the prescribed period, a land-registry certificate for the property where the project would operate. Because the company knew of that requirement and failed to satisfy it, the conditioned act could be rendered ineffective and the file closed through an administrative verification, without an annulment proceeding or a declaration of lesividad. Consequently, the company had acquired neither a vested subjective right nor an effective mining concession that the Court could recognize, and there was no breach of legitimate expectations, the doctrine protecting an administration’s own acts, or due process. The Court also denied compensation, ordered the company to pay costs, and rejected the limitations defense.El Tribunal Contencioso Administrativo rechazó íntegramente la demanda de Eco Proyecciones del Nuevo Milenio S.A., que pretendía anular varias resoluciones de SETENA, la Dirección de Geología y Minas y el MINAE, restablecer la viabilidad ambiental y la concesión para explotar el Tajo Asunción, y obtener daños y perjuicios. Determinó que la viabilidad ambiental había sido otorgada bajo una condición suspensiva: presentar dentro del plazo concedido la certificación registral de la propiedad donde se desarrollaría el proyecto. Como la empresa conocía esa exigencia y no la cumplió, el acto condicionado podía dejarse sin efecto y archivarse el expediente mediante una constatación administrativa, sin procedimiento de nulidad ni declaratoria de lesividad. Por ello, no existían un derecho subjetivo adquirido, una concesión minera eficaz que el Tribunal pudiera reconocer ni violaciones a la confianza legítima, la intangibilidad de los actos propios o el debido proceso. También rechazó la indemnización, condenó a la empresa en costas y desestimó la defensa de caducidad.

The Agrarian Court revoked the precautionary measure that had suspended all forestry activities on the disputed property, finding it disproportionate to halt the entire harvest of a melina plantation when the controversy centered on a possible overlap between properties and less burdensome mechanisms could protect the disputed assets. Instead, it authorized the corporate codefendant to dispose of trees already cut under judicial oversight: an expert selected from the Judiciary’s official roster must determine their quantity, location, species, condition, suitability for use, and market value. The timber must then be entrusted to the defendant as judicial custodian for sale through the Forest Products Exchange, while transportation must comply with Article 31 of the Forestry Law. The court also required an assessment of trees not yet harvested and safeguards for their value. In addition, it annulled a later order allowing disposal of the timber upon a mortgage guarantee because the lower court had failed to resolve pending motions and adequately protect due process.El Tribunal Agrario revocó la medida cautelar que había suspendido todas las actividades forestales en el inmueble en disputa, al considerar desproporcionado paralizar íntegramente el aprovechamiento de una plantación de melina cuando el conflicto se concentraba en un posible traslape de fincas y existían mecanismos menos gravosos para proteger los bienes litigiosos. En su lugar, autorizó a la sociedad codemandada a disponer de los árboles ya cortados bajo control judicial: una persona experta del rol oficial debe determinar cantidad, ubicación, especies, estado, posibilidad de aprovechamiento y valor de mercado; después, la madera debe entregarse en depósito judicial para su colocación en la Bolsa de Productos Forestales, respetando el artículo 31 de la Ley Forestal. También ordenó evaluar los árboles aún no aprovechados y asegurar el depósito de su valor. Asimismo, anuló una resolución posterior que había permitido disponer de la madera mediante una garantía hipotecaria, pues fue dictada sin resolver debidamente las gestiones pendientes ni garantizar plenamente el debido proceso.

El documento aprobado mediante la resolución 866-2000-SETENA únicamente comprendía la recopilación y el análisis de información bibliográfica, sin labores de campo ni interacción con el ambiente; por ello, su denominación administrativa como estudio de impacto ambiental no podía modificar su verdadera naturaleza. Esa aprobación tampoco otorgó viabilidad ambiental para las actividades de investigación de campo. En consecuencia, la negativa estatal a suscribir el contrato respondió a razones técnico-jurídicas y al principio de legalidad, no a motivos políticos. Se acogió la excepción de falta de derecho, se declaró sin lugar la demanda y se impusieron ambas costas a la actora.

Acting as the municipality’s improper hierarchical appellate authority, the Administrative Litigation Court annulled an Alajuela mayoral decision that had allowed a cement plant’s works to be regularized and completed through a purported reassessment of the construction permit. The Court found that the original permit authorized only an industrial building and an administrative building—not the grinding tower, silos, electrical substation, or other cement-production facilities. The challenged action omitted essential requirements, including a land-use certificate and the applicable environmental-impact and road-feasibility studies, and lacked technical and legal support. Because the unauthorized facilities posed risks to the environment and the health of nearby residents, the Court applied the precautionary principle, ordered their immediate closure, and annulled related measures that depended on the invalid decision. The Municipality was directed to redo and cure the procedures. It could permit the plant to operate only if the project complied with all applicable rules, including urban zoning; otherwise, it had to order demolition of the structures erected without the required construction permit.El Tribunal Contencioso Administrativo, actuando como jerarca impropio municipal, anuló la resolución de la Alcaldía de Alajuela que había permitido regularizar y completar las obras de una cementera mediante una supuesta retasación de la licencia constructiva. Determinó que el permiso original autorizaba únicamente una nave industrial y un edificio administrativo, no la torre de molienda, los silos, la subestación eléctrica ni las restantes instalaciones de producción de cemento. La actuación impugnada omitió requisitos esenciales, entre ellos el certificado de uso de suelo y los estudios ambientales y de viabilidad vial aplicables, y carecía de fundamento técnico y normativo. Debido al riesgo para el ambiente y la salud de la población vecina, el Tribunal aplicó el principio precautorio, ordenó la clausura inmediata de las obras levantadas sin licencia y anuló por conexidad las actuaciones que dependían de la resolución inválida. La Municipalidad debía reponer los procedimientos y, si las obras no resultaban conformes con la normativa urbano-ambiental, ordenar su demolición.
