It should be noted that the principle of reasonableness and proportionality plays a first-order role in Administrative Law across various fields. It is therefore vitally important as a limit on administrative discretion, since the General Public Administration Law provides that discretionary administrative acts may not contravene unequivocal rules of science or technique, or elementary principles of justice, logic, or convenience (Articles 16(1), 158(4), and 160).Conviene indicar que el principio de razonabilidad y proporcionalidad cumple un rol de primer orden en el Derecho Administrativo, al proyectarse en diversos ámbitos. Así, es de vital importancia como límite al ejercicio de la discrecionalidad administrativa, al establecer la Ley General de la Administración Pública que no podrán dictarse actos administrativos discrecionales contrarios a las reglas unívocas de la ciencia o de la técnica, o a los principios elementales de justicia, lógica o conveniencia (artículos 16, párrafo 1°, 158, párrafo 4° y 160).

A flexible, double-edged control on public action. Courts examine whether a measure is legally permissible, suitable to its stated end, necessary among available alternatives, and balanced in its effects; the precise formulation and intensity of review depend on the proceeding and the right affected. The same analysis can test an environmental restriction, a sanction, or an administrative relaxation of protection. Technical evidence is especially important where the justification rests on environmental risk, linking this principle to objetivacion tutela ambiental. Burdens of proof depend on the governing procedure and claim; they should not be inferred from proportionality alone.Control flexible y de doble vía sobre la actuación pública. Los tribunales examinan si una medida es jurídicamente admisible, idónea para su fin declarado, necesaria entre las alternativas disponibles y equilibrada en sus efectos; la formulación precisa y la intensidad del control dependen del proceso y del derecho afectado. Scope and Limits of Conciliation and ADR Mechanisms for Public AdministrationAlcances y límites de la conciliación y otros mecanismos RAC para la Administración Pública

The Attorney General's Office clarifies the scope and limits of conciliation and other alternative dispute resolution (ADR) mechanisms applicable to municipalities and the entire Public Administration. It recognizes a generic authorization to use these methods, derived from Article 72 of the Contentious-Administrative Procedure Code and the ADR Law, but emphasizes that it is subject to two fundamental limits: the public interest and the principle of legality. The Administration lacks free disposal over matters such as powers of authority (taxation, sanctioning, expropriation), management of public funds, public domain, continuous provision of essential public services, and binding legal opinions. However, it admits some negotiation leeway regarding specific patrimonial consequences, such as the method of tax payment, the determination of just compensation in expropriations, or the State's patrimonial liability. Finally, it reconsiders ex officio Opinion C-205-2001 to conclude that conciliation is indeed a valid mechanism for disputes arising from public employment relationships.La Procuraduría General de la República aclara los alcances y límites de la conciliación y demás mecanismos alternos de resolución de conflictos (RAC) aplicables a las municipalidades y a toda la Administración Pública. Reconoce una habilitación genérica para acudir a estos medios, derivada del artículo 72 del Código Procesal Contencioso Administrativo y de la Ley RAC, pero subraya que está sujeta a dos límites fundamentales: el interés público y el principio de legalidad. La Administración carece de libre disposición sobre materias como las potestades de imperio (tributaria, sancionadora, expropiatoria), el manejo de fondos públicos, el dominio público, la prestación continua de servicios públicos esenciales y los dictámenes vinculantes. No obstante, admite ciertos márgenes de negociación respecto de consecuencias patrimoniales concretas, como la forma de pago de tributos, la determinación del justiprecio en expropiaciones, o la responsabilidad patrimonial del Estado. Finalmente, reconsidera de oficio el dictamen C-205-2001 para concluir que la conciliación sí es un mecanismo válido en los conflictos derivados de relaciones de empleo público.

Executive Decree 43898-MINAE-S-MOPT-MAG-MEIC establishes Costa Rica's new regulatory framework for environmental assessment, control, and monitoring, replacing the previous regulation (Decree 31849). It modernizes and streamlines the Environmental Impact Assessment (EIA) process before SETENA. The Decree defines the assessment instruments (D1+DJCA, D1+P-PGA, D1+EsIA, D1-C, D1-Torres, D4-Forestal, D6-Cuadrante Urbano) and their application based on a new categorization using Environmental Impact Significance (SIA) and lists of activities (ISIC). It introduces the Digital Environmental Logbook for follow-up, regulates environmental guarantees, citizen participation, the register of consultants, and a detailed sanctioning procedure. The regulation emphasizes post-approval control and consultant responsibility, aiming for greater efficiency and legal certainty in environmental governance.El Decreto Ejecutivo 43898-MINAE-S-MOPT-MAG-MEIC establece el nuevo marco regulatorio para la evaluación, control y seguimiento ambiental en Costa Rica, derogando el reglamento anterior (Decreto 31849). Moderniza y simplifica el proceso de Evaluación de Impacto Ambiental (EIA) ante la SETENA. Regulation on Sanctions for Unauthorized Access to Genetic and Biochemical ResourcesReglamento de Sanciones por Acceso No Autorizado a Recursos Genéticos y Bioquímicos

This executive decree establishes the administrative sanctioning procedure to apply fines and measures provided in Articles 112 and 113 of the Biodiversity Law No. 7788, in cases of unauthorized access to genetic and biochemical resources of Costa Rican biodiversity. It defines unauthorized access as access carried out without a permit from the CONAGEBIO Technical Office, or that does not respect the terms of the prior informed consent. It regulates all stages of the procedure, from the complaint or ex officio action, preliminary investigation, oral and private hearing, to the final resolution. It includes the possibility of conciliation between the resource provider and the alleged offender, which must be approved by the OT and can avoid the imposition of a fine if it satisfies the public interest. It provides for precautionary measures and criteria for grading sanctions according to the seriousness of the infraction, such as intent, benefit obtained, environmental impact, and recidivism. Fines range from one to twelve base salaries.Este decreto ejecutivo establece el procedimiento administrativo sancionador para aplicar las multas y medidas previstas en los artículos 112 y 113 de la Ley de Biodiversidad N° 7788, en casos de acceso no autorizado a los recursos genéticos y bioquímicos de la biodiversidad costarricense. Define el acceso no autorizado como aquel realizado sin permiso de la Oficina Técnica de la CONAGEBIO, o que no respete los términos del consentimiento previamente informado. Regula todas las etapas del procedimiento, desde la denuncia o actuación de oficio, la investigación preliminar, la audiencia oral y privada, hasta la resolución final. Incluye la posibilidad de conciliación entre el proveedor del recurso y el presunto infractor, la cual debe ser homologada por la OT y puede evitar la imposición de multa si satisface el interés público. Contempla medidas cautelares y criterios para graduar las sanciones según la gravedad de la infracción, como el dolo, el beneficio obtenido, el impacto ambiental y la reincidencia. Las multas oscilan entre uno y doce salarios base.

Mining Code RegulationReglamento al Código de Minería

Executive Decree 29300-MINAE provides comprehensive regulation for mining activity in Costa Rica, covering exploration permits, exploitation concessions, and artisanal mining. It sets forth technical, financial, and environmental requirements, including the obligation to obtain environmental viability from SETENA through an Environmental Impact Study and SINAC certification that the area is not protected. It defines the powers of the Directorate of Geology and Mines (DGM), application procedures, rights and obligations of permit and concession holders, payment of surface fees, environmental guarantees, and work reports. The decree also regulates mining by municipalities and autonomous institutions for public works and prohibits mining in National Parks, Biological Reserves, and beaches. It incorporates precautionary and in dubio pro natura principles for suspension of activities in case of environmental damage. The decree was repealed in 2022 by Decree 43443.El Decreto Ejecutivo 29300-MINAE establece la reglamentación integral para la actividad minera en Costa Rica, abarcando permisos de exploración, concesiones de explotación y minería artesanal. Regula los requisitos técnicos, financieros y ambientales, incluyendo la obligación de obtener viabilidad ambiental de SETENA mediante Estudio de Impacto Ambiental, y la exigencia de certificación del SINAC de que el área no está protegida. Define las competencias de la Dirección de Geología y Minas (DGM), el procedimiento de solicitud, los derechos y obligaciones de permisionarios y concesionarios, el pago de canon de superficie, la garantía ambiental, y los informes de labores. También regula la actividad minera de municipalidades e instituciones autónomas para obras de interés público, y prohíbe la minería en Parques Nacionales, Reservas Biológicas y playas. Incorpora principios precautorios y de indubio pro natura para la suspensión de labores ante daño ambiental. El decreto fue derogado en 2022 por el Decreto 43443.

Reclassification of the 2000-meter inalienable border strip and its impact on State Natural Heritage and indigenous territoriesDesafectación de la franja fronteriza inalienable de 2000 metros y su impacto en el Patrimonio Natural del Estado y territorios indígenas

The Attorney General's Office responds to the inquiry of Deputy Mario Núñez Arias regarding the constitutionality of a potential law that would declassify the inalienable two-thousand-meter strip along the borders with Nicaragua and Panama, established in Article 7(f) of the Land and Colonization Law. The opinion reviews prior bills and reaffirms the institutional opposition to such initiatives. The PGR argues that declassification would harm the State's Natural Heritage (protected areas, wildlife refuges, and biological corridors) and indigenous territories, violating Article 50 of the Constitution, the precautionary principle, and ILO Convention 169. It stresses that any reduction of protected areas requires prior technical justification consistent with Article 38 of the Environmental Organic Law. It further emphasizes that solving individual titling problems cannot override environmental protection and national security, recommending alternatives such as concessions or use permits.La Procuraduría General de la República responde a la consulta del diputado Mario Núñez Arias sobre la viabilidad constitucional de una eventual ley que desafecte la franja inalienable de dos mil metros a lo largo de las fronteras con Nicaragua y Panamá, prevista en el inciso f) del artículo 7 de la Ley de Tierras y Colonización. El pronunciamiento analiza proyectos de ley anteriores (expedientes 14.134 y 14.681) y reafirma la oposición institucional a este tipo de iniciativas. La PGR sostiene que la desafectación vulneraría el Patrimonio Natural del Estado (áreas protegidas, refugios de vida silvestre y corredores biológicos fronterizos) y los territorios indígenas, contraviniendo el artículo 50 constitucional, el principio precautorio y el Convenio 169 de la OIT. Señala que toda reducción de áreas protegidas requiere estudios técnicos previos que la justifiquen, de conformidad con el artículo 38 de la Ley Orgánica del Ambiente. Además, enfatiza que no se puede sacrificar la protección ambiental y la seguridad nacional para solucionar problemas particulares de titulación, recomendando figuras alternativas como concesiones o permisos de uso.

Scope of Administrative Procurement on Puntarenas Tourist Promenade and Coastal Landscape ProtectionAlcance de la contratación administrativa en el Paseo de los Turistas de Puntarenas y tutela del paisaje costero

This legal opinion addresses a legislator's query on whether Articles 2 and 41 of the Administrative Procurement Law apply to the lease of undeveloped land on the Paseo de los Turistas in Puntarenas. The Attorney General's Office conducts an extensive historical-legal analysis of the city, concluding that these lands, along with those of the Paseo León Cortés and the southern beach, are designated for common public use as seaside promenades and open spaces, thus precluding lease or concession. It grounds this in Law 1309 of 1951, the Urban Planning Law, the Water Law, and constitutional protection of landscape and natural beauty. The opinion sua sponte modifies prior criteria on the leasing of built-up land and on marinas in the estuary, reaffirming the protection of the coastal landscape as a safeguarded legal interest and the prohibition of private uses that degrade it.Esta opinión jurídica responde a la consulta de un diputado sobre si los artículos 2 y 41 de la Ley de Contratación Administrativa aplican al arrendamiento de terrenos no edificados en el Paseo de los Turistas de Puntarenas. La Procuraduría realiza un extenso análisis histórico-jurídico de la ciudad, concluyendo que dichos terrenos, junto con los del Paseo León Cortés y la playa sur, están destinados al uso público común como paseos marítimos y espacios abiertos, excluyendo su arrendamiento o concesión. Se fundamenta en la Ley 1309 de 1951, la Ley de Planificación Urbana, la Ley de Aguas y la tutela constitucional del paisaje y bellezas naturales. La opinión modifica de oficio criterios previos sobre la posibilidad de arrendar terrenos construidos y sobre marinas en el estero, reafirmando la protección del paisaje costero como bien jurídico tutelado y la prohibición de usos privativos que lo desmejoren.

Free access to public zone and public roads in the Papagayo Tourism ProjectAcceso libre a zona pública y vías públicas en el Proyecto Turístico de Papagayo

The Attorney General’s Office responds to Mr. Gad Amit Kaufman, who reports non-compliance with a Constitutional Court order to open and allow free transit on roads leading to the beaches of the Papagayo Project. The request to sanction public officials and private parties is denied because the Attorney General’s Office lacks sanctioning authority; its legal oversight over the maritime terrestrial zone is limited to ensuring compliance with the law, without substituting for administrative or judicial bodies. However, a legal opinion is issued on several aspects: the obligation to respect the fifty-meter public zone, the public nature of roads within the project, and the Attorney General’s position regarding the challenged Road Regulation. It concludes that the entry form discourages access to the public zone, that the project does not constitute an exceptional regime and must respect public road legislation, and that the Constitutional Court is the sole authority to address the alleged disobedience of its order.La Procuraduría responde al señor Gad Amit Kaufman, quien denuncia el incumplimiento de una orden de la Sala Constitucional que ordenaba la apertura y libre tránsito de caminos hacia las playas del Proyecto Papagayo. La solicitud de sancionar a funcionarios y particulares es denegada porque la Procuraduría carece de potestad sancionatoria; su control jurídico sobre la zona marítimo terrestre se limita a velar por el cumplimiento de la normativa, sin sustituir a los órganos administrativos o judiciales. No obstante, se emite opinión jurídica sobre varios aspectos: la obligación de respetar la zona pública de cincuenta metros, el carácter público de las vías dentro del proyecto, y la posición de la Procuraduría frente al Reglamento de Vialidad impugnado. Se concluye que el formulario de ingreso desestimula el acceso a la zona pública, que el proyecto no constituye un régimen de excepción y debe respetar la legislación sobre vías públicas, y que la Sala Constitucional es la única competente para conocer el presunto desacato a su orden.

Analysis of the Mining Code Bill — marine resources, protected areas and environmental impactAnálisis del Proyecto de Código de Minería — recursos marinos, áreas protegidas e impacto ambiental

The Attorney General's Office analyzes the Mining Code bill (file 10.099) and issues substantial observations. It notes that Article 1 omits the patrimonial sea, reducing state dominion to metallic and non-metallic deposits in the territory and territorial sea, contradicting the current code and Article 6 of the Constitution. It recommends maintaining the express prohibition on encumbering or transferring deposits, and that the Legislative Assembly retain the power to grant concessions in marine areas, in accordance with Opinion C-128-91. It objects to the exclusion of legislative approval for exploitation in indigenous reserves (current Article 8) and the reliance solely on community authorization, citing ILO Convention 169. It questions the transfer of mining administration to the MEIC instead of MINAE, and the failure to require an environmental impact study prior to granting. It warns of a contradiction with the Forestry Law by allowing mining in protected wild areas, and the unconstitutionality of Article 152 on double punishment. It urges that the bill be rethought to ensure economic, social and environmental benefits for the State and to protect the highest national interests.La Procuraduría General de la República analiza el proyecto de Código de Minería (expediente 10.099) y emite observaciones sustanciales. Señala que el artículo 1 omite incluir el mar patrimonial, reduciendo el dominio estatal a yacimientos metálicos y no metálicos en territorio y mar territorial, en contradicción con el código vigente y el artículo 6 constitucional. Recomienda mantener la prohibición expresa de gravar o traspasar yacimientos, y que la Asamblea Legislativa conserve la potestad de otorgar concesiones en áreas marinas, conforme al dictamen C-128-91. Objeta la exclusión de la aprobación legislativa para explotación en reservas indígenas (artículo 8 vigente) y que se pretenda solo la autorización comunitaria, citando el Convenio 169 de la OIT. Cuestiona que la administración minera pase al MEIC en vez de MINAE, y que no se exija el estudio de impacto ambiental previo al otorgamiento. Advierte contradicción con la Ley Forestal al permitir minería en áreas silvestres protegidas, y la inconstitucionalidad del artículo 152 sobre doble sanción. Insta a replantear el proyecto para asegurar beneficios económicos, sociales y ambientales para el Estado y proteger los altos intereses nacionales.

Publication and Legal Nature of Municipal Regulatory PlansPublicación y naturaleza de los planes reguladores municipales

The Attorney General's Office determined that municipal regulatory plans are normative and regulatory in nature. Based on the Urban Planning Law, the Municipal Code, and the General Public Administration Law, it concluded that merely publishing a notice of adoption is insufficient; the entire content of the plan must be published in the Official Gazette, including maps, plans, and regulations, in order for it to become legally effective and binding on both the Administration and private parties. The lack of publication does not invalidate the plan but prevents it from producing legal effects vis-à-vis third parties, without eliminating other municipal powers of urban regulation.La Procuraduría General de la República determinó que los planes reguladores municipales poseen naturaleza normativa y reglamentaria. Con base en la Ley de Planificación Urbana, el Código Municipal y la Ley General de la Administración Pública, concluye que no basta con publicar un aviso de adopción; debe publicarse el contenido íntegro del plan en el Diario Oficial, incluidos mapas, planos y reglamentos, para que adquiera eficacia jurídica y vincule a la Administración y a los particulares. La falta de publicación no invalida el plan, pero le impide surtir efectos frente a terceros, sin que ello elimine otras competencias municipales de ordenación urbana.

Charging fees for telecommunications use permits in protected wilderness areasCobro de canon por permisos de uso para instalaciones de telecomunicación en áreas silvestres protegidas

The Attorney General's Office analyzes whether it is mandatory to charge a fee to every person holding a use permit for telecommunications installations in protected wilderness areas, given that some entities claim to be exempt. The opinion clarifies that the fee is not a tax but a public price set by executive decree, so exemptions must be expressly provided. It concludes that the Costa Rican Railway Institute (INCOFER), as an autonomous institution, must pay the fee pursuant to Article 7(c) of Decree 26187, while the Central American Air Navigation Services Corporation (COCESNA), by virtue of its Constituent Agreement (Articles 6 and 22), enjoys the same privileges as official entities and is exempt from payment.La Procuraduría General de la República analiza si es obligatorio cobrar el canon a toda persona que tenga permiso de uso para instalaciones de telecomunicación en áreas silvestres protegidas, ante la oposición de algunas entidades que alegan estar exoneradas. La opinión aclara que el canon no es un tributo, sino un precio público fijado por decreto ejecutivo, por lo que las exoneraciones deben estar expresamente previstas. Concluye que el Instituto Costarricense de Ferrocarriles (INCOFER), como institución autónoma, sí debe pagar el canon según el artículo 7 inciso c) del Decreto 26187, mientras que la Corporación Centroamericana de Servicios de Navegación Aérea (COCESNA), en virtud de su Convenio Constitutivo (artículos 6 y 22), goza de los mismos privilegios de los entes oficiales y está exenta del pago.

Constitutionality of Decree 31750-MINAE-TUR on Ecotourism in MTC Forest AreasConstitucionalidad del Decreto 31750-MINAE-TUR sobre ecoturismo en bosques de la ZMT

The Attorney General's Office, responding to the unconstitutionality action against Decree 31750-MINAE-TUR, argues that the decree contains constitutional defects. The Decree regulates ecotourism in forested areas of the maritime terrestrial zone (MTC) designated by MINAE, but in doing so it transfers to municipalities the authority to grant concessions over the State's Natural Heritage (PNE), which is MINAE's exclusive competence and contrary to Article 13 of the Forestry Law and Article 73 of Law 6043. It also allows tree felling and forest harvesting in protected wildlands, prohibited by the Forestry Law, and permits buildings up to three stories high and uses of space that may cause environmental damage. The Attorney General's Office believes that by omitting regulation for other PNE areas outside the MTC, it breaches the principles of reasonableness, proportionality, and equality. It concludes that the Decree harms the fundamental right to a healthy and ecologically balanced environment, enshrined in Article 50 of the Constitution.La Procuraduría General de la República, al contestar la acción de inconstitucionalidad contra el Decreto 31750-MINAE-TUR, sostiene que la norma presenta vicios de constitucionalidad. El Decreto reglamenta el ecoturismo en áreas boscosas de la zona marítimo terrestre (ZMT) demarcadas por el MINAE, pero al hacerlo traslada a las municipalidades la competencia para otorgar concesiones sobre el Patrimonio Natural del Estado (PNE), lo cual es exclusivo del MINAE y contraria los artículos 13 de la Ley Forestal y 73 de la Ley 6043. Además, permite la corta de árboles y aprovechamiento forestal en áreas silvestres protegidas, prohibido por la Ley Forestal, y autoriza construcciones de hasta tres niveles y uso de espacios que pueden causar daños ambientales. La Procuraduría considera que al omitir la regulación para otras áreas del PNE fuera de la ZMT, se violan los principios de razonabilidad, proporcionalidad e igualdad. Concluye que el Decreto lesiona el derecho fundamental a un ambiente sano y ecológicamente equilibrado, consagrado en el artículo 50 constitucional.

Finalmente, se señalaron inconsistencias técnicas graves: los ocupantes actuales no son poseedores legales porque los bienes demaniales no son susceptibles de posesión ad usucapionem, por lo que la ley solo sería aplicable diez años después de la desafectación, y el procedimiento no sería ante el IDA sino ante los tribunales, lo que vacía de sentido práctico la iniciativa.

Validity of the decree creating the Tivives Protective Zone vis-à-vis the Caldera port reserve zoneValidez del decreto de creación de la Zona Protectora de Tivives frente a la zona de reserva portuaria de Caldera

The Attorney General's Office examines whether Executive Decree 17.023-MAG, which established the Tivives Protective Zone, lost force or validity in light of Law 5582 (Caldera port reserve zone) and its amendments. It holds that the conflict between the law and the decree is one of validity, not repeal. It concludes that, under the principle of normative hierarchy, the decree would be invalid for subjecting to the forestry regime lands already designated by law for a different public purpose (port construction). However, in mandatory compliance with Constitutional Chamber precedent 2004-08928 (Isla San Lucas), the decree is deemed valid, since the Chamber allows protected areas to be established by decree on lands with a preexisting legal purpose, in development of Article 50 of the Constitution. It also applies precedent 07294-98, requiring technical studies to reduce protected areas, and states that the 1999 reform ordering a municipal regulatory plan would be unconstitutional as it implies an unjustified reduction of the protective zone.La PGR analiza si el Decreto Ejecutivo 17.023-MAG, que creó la Zona Protectora de Tivives, perdió vigencia o validez ante la Ley 5582 (zona de reserva portuaria de Caldera) y sus reformas. Sostiene que el conflicto entre la ley y el decreto es de validez, no de derogación. Concluye que, según el principio de jerarquía normativa, el decreto sería inválido por someter al régimen forestal terrenos afectados por ley a un fin público distinto (construcción del puerto). Sin embargo, en acatamiento obligatorio del precedente constitucional 2004-08928 (Isla San Lucas), determina que el decreto es válido, pues la Sala Constitucional permite establecer áreas protegidas por decreto en terrenos con destino legal distinto, en desarrollo del artículo 50 constitucional. También aplica el precedente 07294-98, que exige estudios técnicos para reducir áreas protegidas, e indica que la reforma de 1999 que ordenaba un plan regulador municipal sería inconstitucional al implicar reducción injustificada de la zona protectora.

Finalmente, la falta de publicación de los planos de zonificación vicia la eficacia del Plan solo en los aspectos que requieran de esos planos, aplicándose el resto del contenido normativo publicado.

No legal basis for granting forest use permits in the Border Corridor Wildlife RefugeImprocedencia de permisos de aprovechamiento forestal en Refugio de Vida Silvestre Corredor Fronterizo

The SINAC asks whether MINAE may issue forest use permits in the Border Corridor Wildlife Refuge. The PGR also rules out adverse possession by private parties or Law No. 7599 as a basis for permits, because public‑domain assets are imprescriptible and any title issued under that law remains subject to forestry prohibitions. La PGR también descarta que la posesión decenal de particulares o la Ley 7599 puedan servir de base para autorizar aprovechamientos, ya que los bienes demaniales son imprescriptibles y la titularidad bajo esa ley está sujeta a las prohibiciones forestales vigentes. Se menciona la acción de inconstitucionalidad pendiente contra el artículo 8 de la Ley 7599.

The Attorney General's Office addresses two queries from MINAE. On the first, it concludes that Decree 31750-MINAE-TUR has multiple unconstitutional flaws: it improperly delegates to municipalities the administration and granting of concessions over State Natural Heritage in the maritime-terrestrial zone, violating Forestry Law and Law 6043; it allows tree felling and forest use in Protected Wild Areas, contrary to legal prohibitions; it authorizes land-use change and environmental damage; it regulates only maritime-terrestrial zone forests, violating principles of reasonableness, proportionality, and equality; and it merges divergent planning (Regulatory Plans and Management Plans). These flaws reach constitutional significance by affecting the right to a healthy environment (Article 50). On the second question, it reaffirms that administration of forests on the maritime-terrestrial zone belongs to MINAE, and municipalities are barred from granting concessions on them.La Procuraduría analiza dos consultas del MINAE. Estos vicios trascienden al plano constitucional por afectar el derecho a un medio ambiente sano (art. 50). Sobre la segunda pregunta, reafirma que la administración de los bosques y terrenos forestales de la zona marítimo terrestre corresponde al MINAE, y que las municipalidades están inhibidas de otorgar concesiones sobre ellos.

The IDA's Regulation for Titling Lands in National Reserves is found unconstitutional for invading executive and legislative powers, lacking legal basis, failing to protect public domain and environmental assets, and creating a parallel procedure to the judicial one. It concludes that a future decree for the same purpose would also be improper, lacking enabling law and violating principles of legal reserve and separation of powers. It recommends canceling properties registered under IDA's name so possessors can use the judicial possessory information process.La Procuraduría General de la República analiza si es viable que el Instituto de Desarrollo Agrario (IDA) titule tierras ubicadas en reservas nacionales mediante un decreto ejecutivo. Se revisan los antecedentes de la Ley de Titulación Múltiple y la Ley 7599, ambas declaradas inconstitucionales por la Sala Constitucional por vicios de procedimiento y por permitir la titulación indiscriminada de áreas protegidas. Se examina el Reglamento para la Titulación de Tierras en Reservas Nacionales emitido por el IDA, concluyendo que es inconstitucional por invadir competencias del Poder Ejecutivo y Legislativo, carecer de base legal, desproteger bienes de dominio público y el ambiente, y crear un procedimiento paralelo al judicial. Se determina que un futuro decreto con el mismo fin también sería improcedente, al no existir ley habilitante y violar principios de reserva de ley y división de poderes. Se recomienda cancelar las fincas inscritas a nombre del IDA para que los poseedores puedan acudir a la vía judicial de informaciones posesorias.

The Attorney General’s Office, at the request of the National Environmental Technical Secretariat (SETENA), analyzes whether SETENA may require additional studies and documents from those requesting environmental viability for projects presented as agricultural subdivisions, but which are actually intended for urban development, and what sanctions apply for abusive use of that regulation. The opinion concludes that SETENA, in the exercise of its broad legal powers and in fulfillment of the State’s duty to protect the right to a healthy environment, is authorized to require any additional study or information it deems pertinent and necessary to determine the true environmental nature of the project and prevent damage, provided its decision is reasoned, rational, and proportionate. It also identifies the administrative sanctioning regimes applicable in case of non-compliance, ranging from suspension to closure and execution of guarantees, without prejudice to criminal liability.La Procuraduría General de la República, a solicitud de SETENA, analiza si esta entidad puede exigir estudios y documentos adicionales a quienes soliciten viabilidad ambiental para proyectos presentados como fraccionamientos agrícolas, pero que en realidad se destinan a urbanizaciones, y qué sanciones aplicar ante el uso abusivo de esa normativa. El dictamen concluye que SETENA, en ejercicio de su amplia competencia legal y en cumplimiento del deber estatal de proteger el derecho a un ambiente sano, está facultada para requerir cualquier estudio o información adicional que considere pertinente y necesaria para determinar la verdadera naturaleza ambiental del proyecto y prevenir daños, siempre que su decisión sea motivada, razonable y proporcional. También señala los regímenes sancionatorios administrativos aplicables en caso de incumplimiento, que van desde la paralización hasta la clausura y ejecución de garantías, sin perjuicio de la responsabilidad penal.

The Attorney General's Office concludes that the Costa Rican Institute of Aqueducts and Sewers (AyA) is not legally authorized to use water resources within state-owned protected wild areas for human consumption. It argues that Article 18 of the Forestry Law exhaustively lists only research, training, and ecotourism as permitted activities. AyA's authority to use public water nationwide, granted by Article 2(f) of its enabling law, must be interpreted in harmony with the later, special Forestry Law, rendering it inapplicable in such areas. The opinion states that such use would require an express law expanding permitted activities. Moreover, any water capture would constitute a change in public domain destination, reducing the protected area, which under Article 38 of the Environmental Law requires technical studies and legislative approval. Width of access roads to the maritime-terrestrial zoneAncho de vías de acceso a la zona marítimo terrestre

The Attorney General's Office analyzes whether access points to the public zone of the maritime-terrestrial zone established in a coastal regulatory plan must comply with the 14-meter width required by the General Public Roads Law for local roads, or if they may be governed by the plan itself. It concludes that the Maritime-Terrestrial Zone Law does not specify a width for such accesses, and that Article 4 of the General Public Roads Law does not regulate the width of local streets within the cantonal road network. Therefore, when the access is a local street, the municipality must define its width in the regulatory plan, based on criteria of reasonableness, proportionality, and technical soundness, without being bound to 14 meters. If the access is via a national road, the 20-meter width set by the MOPT applies.La Procuraduría General de la República analiza si los accesos a la zona pública de la zona marítimo terrestre previstos en un plan regulador costero deben ajustarse al ancho de 14 metros que establece la Ley General de Caminos Públicos para los caminos vecinales, o si pueden regirse por lo dispuesto en el propio plan regulador. Overlap between protected wild areas and indigenous reservesTraslape de áreas silvestres protegidas y reservas indígenas

The Attorney General's Office responds to SINAC's consultation on four questions. First, it determines that the inalienability declaration of the 2000-meter zone on both sides of the South Inter-American Highway (Robledales zone) is NOT in force, following the repeal of Articles 7(a) and 10 of the Land and Colonization Law. Second, it analyzes the overlap between protected wild areas and indigenous reserves, concluding that both regimes are incompatible and mutually exclusive: protected areas are state property (natural heritage of the State), while indigenous reserves are communal property. Therefore, the same area cannot be under both regimes. Third, it clarifies that if an indigenous reserve was created by decree and overlaps a protected wild area, an irregular deaffectation occurs, which can be challenged constitutionally (as happened with the Guaymí de Osa Indigenous Reserve). Fourth, regarding SINAC's powers, it states that in overlapped territories, as long as the indigenous reserve decree is not annulled, administration belongs to the indigenous people and CONAI, not SINAC. Any state regulation on natural resources within indigenous reserves must be previously consulted with the indigenous people and authorized by CONAI, in accordance with ILO Convention 169.La Procuraduría General de la República responde a la consulta del SINAC sobre cuatro interrogantes. Primero, determina que la declaratoria de inalienabilidad de la zona de 2000 metros a ambos lados de la Carretera Interamericana Sur (zona de los Robledales) NO está vigente, tras la derogación de los artículos 7 inciso a) y 10 de la Ley de Tierras y Colonización. Segundo, analiza el traslape entre áreas silvestres protegidas y reservas indígenas, concluyendo que ambos regímenes son incompatibles y excluyentes: las ASP son propiedad estatal (patrimonio natural del Estado), mientras las reservas indígenas son propiedad comunitaria. Por tanto, una misma área no puede estar bajo ambos regímenes. Tercero, aclara que si una reserva indígena fue creada por decreto y traslapa un área silvestre protegida, se produce una desafectación irregular, impugnable constitucionalmente (como ocurrió con la Reserva Indígena Guaymí de Osa). Cuarto, sobre competencias del SINAC, señala que en territorios traslapados, mientras el decreto de la reserva indígena no sea anulado, la administración corresponde a los indígenas y a CONAI, no al SINAC. Cualquier regulación estatal sobre recursos naturales en reservas indígenas debe ser consultada previamente al pueblo indígena y contar con autorización de CONAI, conforme al Convenio 169 de la OIT.

It concludes that such activities cannot be authorized if they differ from those allowed by Article 18 of the Forestry Law (research, training, ecotourism, and water extraction for human consumption), because ASPs are part of the State's natural heritage and there is no legal norm implementing the second paragraph of Convention 169 Article 14.1. Any future authorization would require a new law with adequate technical justification, in line with the principles of science-based environmental protection, reasonableness, and non-regression.La Procuraduría General de la República responde a una consulta del SINAC sobre la posibilidad de autorizar, a través de planes de manejo y reglamentos de uso público, el acceso de pueblos indígenas a Áreas Silvestres Protegidas para realizar actividades tradicionales y de subsistencia al amparo del artículo 14 del Convenio 169 de la OIT. The opinion responds to a request for reconsideration of criterion PGR-C-153-2023, filed by the Minister of Environment and Energy, regarding the possibility of authorizing indigenous traditional activities in protected wild areas and, specifically, the Maleku people's collective fishing practice in the Caño Negro Mixed National Wildlife Refuge. The Attorney General's Office declares the reconsideration inadmissible as untimely and due to lack of standing of the petitioner, since it was not filed by the original consulting body or the higher hierarchical organ. Moreover, it clarifies that the questions raised are specific cases not amenable to binding consultation. However, on its own motion, it expands the previous opinion to indicate that, under Article 9 of the Fishing and Aquaculture Law, fishing in national wildlife refuges is restricted and must conform to MINAE management plans, with no legal authorization to permit non-traditional fishing gear or indigenous activities other than those allowed in protected wild areas of the State's Natural Heritage.El dictamen responde a una solicitud de reconsideración del criterio PGR-C-153-2023, presentada por el Ministro de Ambiente y Energía, sobre la posibilidad de autorizar actividades tradicionales indígenas en áreas silvestres protegidas y, en particular, la práctica de pesca colectiva del pueblo Maleku en el Refugio Nacional de Vida Silvestre Mixto Caño Negro. Denial of Injunction Against Gas Bottling Plant in PozosDenegatoria cautelar contra planta envasadora de gas en Pozos

The Tribunal overturned the interim measure that had suspended the municipal construction permit and the environmental viability granted by SETENA for a liquefied petroleum gas bottling plant in Pozos de Santa Ana. It held that the first-instance decision had taken out of context a reference to the need for a more exhaustive assessment: that requirement arose at an earlier stage and was subsequently satisfied through an Environmental Forecast–Management Plan and other technical studies. According to the Tribunal, construction was supported by permits, administrative oversight, an environmental bond, and assessments addressing explosions, emergencies, hazardous materials, and environmental recovery. The evidence did not sufficiently establish that the works posed a present or potential risk warranting their suspension. In balancing the competing interests, the Tribunal gave weight to legal certainty, the investment already made, and the financial harm caused by stopping construction. Although it recognized the precautionary principle as foundational to environmental law, it declined to treat that principle as decisive given the studies and controls in place, while allowing reconsideration if circumstances later changed.El Tribunal revocó la medida cautelar que había suspendido el permiso de construcción municipal y la viabilidad ambiental otorgada por SETENA a una planta envasadora de gas licuado de petróleo en Pozos de Santa Ana. Teak Harvesting and Proportionality of Interim ReliefCorta de teca y proporcionalidad de la medida cautelar

The Agrarian Court reversed the anticipatory interim measure that had suspended the harvesting, sale, and export of teak from the disputed properties. It found that an ordinary agricultural operation—conducted under forestry supervision and involving employees and third-party contracts—should not be halted to secure an essentially monetary claim whose existence remained to be determined in the principal proceedings. Interim relief must protect the potential right without exceeding the limits of reasonableness and proportionality or causing greater harm than it seeks to prevent. In place of the prohibition, the Court imposed countersecurity on its own motion: the company must submit semiannual income and expenditure reports concerning the cultivation, maintenance, and marketing of the teak plantation. It must also monitor the properties, protect native trees and forest cover within waterbody protection areas, and immediately report any risk or actual damage to SINAC or the Environmental Prosecutor’s Office. The lower court was additionally directed to obtain the administrative records concerning reported cutting within a stream protection area.El Tribunal Agrario revocó la medida cautelar anticipada que había suspendido la corta, venta y exportación de teca en las fincas en conflicto. Cancellation of Mining Concession for Risk to Water ResourcesCancelación de concesión minera por riesgo al recurso hídrico

The First Chamber denied the cassation appeal filed by several Pedregal Group companies against the judgment upholding the suspension of extraction activities and cancellation of a mining concession located over the Colima Superior aquifer near the Virilla River. The Chamber found the administrative intervention lawful in light of groundwater emergence and uncertainty concerning the effects of mining, reasoning that the State may take necessary measures to protect water resources and the environment. It concluded that the concessionaire failed to comply with preventive measures and legal duties concerning pollution control, natural-resource recovery, and the prohibition of operations capable of causing deterioration, particularly to water. Cancellation was not a retroactive sanction but a statutory consequence of breaching obligations inherent in the concession relationship under the Mining Code and Article 50 of the Constitution. The Chamber also found no denial of due process because the companies had opportunities to learn of, challenge, and appeal the administrative decisions.La Sala Primera rechazó el recurso de casación presentado por varias empresas del Grupo Pedregal contra la sentencia que mantuvo la suspensión de las actividades extractivas y la cancelación de una concesión minera situada sobre el acuífero Colima Superior, cerca del río Virilla. La Sala estimó legítima la intervención administrativa ante el afloramiento de aguas y la incertidumbre sobre los efectos de la explotación, pues el Estado puede adoptar las medidas necesarias para proteger el recurso hídrico y el ambiente. Reversal of Tree-Felling Denial Based on Imminent RiskRevocatoria de denegatoria de derribo de árboles por riesgo inminente

MCC MINING CO S.A. sought nullification of SETENA's decision archiving its environmental viability application for the 'Leona de Boston Underground Gold Mining' project, filed in 2003. The company alleged violation of the principles of legitimate expectations, non-retroactivity, and irrevocability of administrative acts, arguing the 2010 amendment to Article 8 of the Mining Code should not apply. The Administrative Appeals Tribunal dismissed all claims. It held that SETENA's 2005 resolution was merely procedural and did not grant any favorable rights or subjective rights. The company had not fulfilled all requirements for environmental viability before the legal change occurred. The amendment declared Abangares a mining reserve, restricting concessions to small-scale worker cooperatives—a status the corporation did not hold. Determinó que la resolución de SETENA de 2005 no constituyó un acto favorable ni generó derechos subjetivos, sino que fue un acto de mero trámite. Además, la empresa no cumplió con todos los requisitos exigidos para obtener la viabilidad ambiental antes del cambio normativo. La modificación legal declaró a Abangares zona de reserva minera, limitando las concesiones a cooperativas de trabajadores de minería en pequeña escala, condición que la empresa no satisfacía. La entrada en vigor de la nueva norma hizo sobrevenir una imposibilidad legal para continuar el trámite, por lo que el archivo fue ajustado a derecho, prevaleciendo los principios de legalidad, precautorio y pro natura sobre las expectativas de la actora.

Liability for Unpermitted Dikes and Flooding in San PancracioResponsabilidad por diques sin permisos e inundaciones en San Pancracio

The Court partially granted the action brought by residents of San Pancracio, Siquirres, who were affected by flooding. It found that Bandeco and Chiquita Brands Costa Rica constructed dikes and carried out earthworks in rivers and canals without the legally required permits. It also held those companies, together with the State, the Municipality of Siquirres, and the National Commission for Risk Prevention and Emergency Response, responsible for failing to conduct the studies required for the works. The Court rejected the statute-of-limitations and standing defenses: the collective constitutional-amparo proceeding filed in 2003 interrupted the limitations period, and the claimants had standing as affected landowners or possessors. It further determined that the settlement’s location in a flood-prone area and the former Agrarian Development Institute’s conduct did not eliminate the defendants’ responsibility. The public entities were ordered to coordinate measures, within one year after the judgment becomes final, to prevent, avoid, and reduce flood impacts, subject to judicial enforcement review.El Tribunal declaró parcialmente con lugar la demanda promovida por habitantes de San Pancracio de Siquirres afectados por inundaciones. Determinó que Bandeco y Chiquita Brands Costa Rica realizaron construcciones de diques y movimientos de tierra en ríos y canales sin los permisos exigidos, y que esas empresas, junto con el Estado, la Municipalidad de Siquirres y la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, omitieron los estudios necesarios para ejecutar las obras. Rechazó las excepciones de prescripción y falta de legitimación activa y pasiva: el amparo colectivo interpuesto en 2003 interrumpió la prescripción y los actores estaban legitimados por su condición de propietarios o poseedores afectados. Asimismo, descartó que la ubicación inundable del asentamiento o la actuación del antiguo IDA eliminaran la responsabilidad de los demandados. Ordenó a los entes públicos coordinar, dentro de un año desde la firmeza, medidas para prevenir, evitar y reducir los impactos de las inundaciones, sujetas a verificación judicial.

Interim Stay of Eviction and Demolition in Public AreaSuspensión cautelar de desalojo y demolición en zona pública

The Court partially granted interim relief against the Municipality of Heredia and stayed Resolution AMH-0803-2024, including the eviction, demolition, and removal of structures from the disputed 50.42-square-meter area. Although the Municipality and SINAC argued that the works encroached on public-domain property intended to protect water resources, the Court noted that the construction had remained on the site for years, whereas the municipal survey and recorded location were relatively recent. It found no evidence that temporarily preserving the existing conditions would cause significant or overriding harm to the public interest or local water resources. Immediate demolition of part of the home, by contrast, could cause serious harm before judicial review of the administrative action’s legality. The ruling did not finally determine ownership, the public-domain status of the land, or the legality of the Municipality’s conduct; it only preserved the stay while the merits of the dispute are adjudicated.El Tribunal declaró parcialmente con lugar la medida cautelar solicitada contra la Municipalidad de Heredia y suspendió los efectos de la resolución AMH-0803-2024, incluida la ejecución del desalojo, demolición y eliminación de estructuras en 50,42 metros cuadrados controvertidos. La resolución no decidió definitivamente la titularidad, la condición demanial del terreno ni la legalidad de la actuación municipal; únicamente mantuvo suspendida su ejecución mientras se conoce el fondo del litigio.

Denial of compensation for precautionary mining suspension in public watercourseImprocedencia de indemnización por medida cautelar de suspensión minera en cauce de dominio público

Sand extraction in the Tempisque River: artisanal mining and environmental protectionExplotación de arena en el Río Tempisque: minería artesanal y protección ambiental

The petitioner, a resident of Filadelfia, Carrillo, Guanacaste, filed an amparo action against several municipalities and MINAE, claiming that mechanized sand extraction in the Tempisque River causes severe environmental damage, endangers the city's retaining wall, and discriminates against traditional artisanal sand miners. Solicitó la suspensión de las actividades mecanizadas, estudios técnicos, y un régimen diferenciado para la minería artesanal. Las autoridades recurridas negaron las violaciones, argumentando falta de competencia o que ejercían sus funciones adecuadamente. La Sala Constitucional analizó las competencias de cada entidad, los principios de razonabilidad, proporcionalidad y precautorio, y el carácter de patrimonio cultural del boyeo artesanal. Concluyó que no se demostró una violación actual de derechos fundamentales, pero ordenó a las instituciones coordinar esfuerzos para proteger el ambiente, salvaguardar la actividad artesanal y garantizar estudios técnicos sobre los impactos de la extracción, sin conceder la medida cautelar de suspensión inmediata.

Aunque la municipalidad sostiene que no autorizó tala alguna y suspendió el convenio, la Sala acredita que los árboles fueron efectivamente marcados y que ni la municipalidad ni el SINAC emprendieron una investigación oficiosa para identificar responsables o causas. La ausencia de acciones concretas más allá de remover las marcas constituye una omisión lesiva del derecho a un ambiente sano. Aplicando los principios precautorio, preventivo, pro natura y de no regresión, el Tribunal ordena iniciar de inmediato un procedimiento para esclarecer los hechos y dictar medidas precautorias que impidan cualquier tala ilegítima. Declara sin lugar el reclamo sobre participación ciudadana, la supuesta privatización del acceso a playa y otros extremos. Se imponen costas a las entidades recurridas.

Challenge to the Environmental Assessment RegulationImpugnación del reglamento de evaluación ambiental

By majority vote, the Constitutional Chamber rejected the constitutional challenge against numerous provisions of Executive Decree No. 43898-MINAE-S-MOPT-MAG-MEIC, the Environmental Assessment, Control and Monitoring Regulation. The claimants argued that the new framework reduced SETENA’s preventive controls, raised thresholds for environmental impact assessment, facilitated activities in environmentally fragile areas, allowed certain forest extraction within protected wildlife areas, and weakened public participation, contrary to constitutional Article 50 and the precautionary, preventive, pro natura, scientific-objectivity, and non-regression principles. In dissent, Justice Fernando Cruz concluded that several amendments lacked technical support and lowered the previously achieved level of environmental protection. He also considered the public consultation conducted through a website inadequate and supported standing to protect diffuse environmental interests and municipal autonomy. Those conclusions form part of the dissenting opinion and do not alter the majority’s rejection of the action.La Sala Constitucional, por mayoría, rechazó la acción promovida contra numerosos artículos del Decreto Ejecutivo n.º 43898-MINAE-S-MOPT-MAG-MEIC, Reglamento de evaluación, control y seguimiento ambiental. Los accionantes sostenían que el nuevo régimen reducía controles preventivos de SETENA, elevaba umbrales para exigir evaluación de impacto ambiental, facilitaba actuaciones en áreas ambientalmente frágiles, permitía determinados aprovechamientos forestales dentro de áreas silvestres protegidas y debilitaba la participación ciudadana, en violación del artículo 50 constitucional y de los principios precautorio, preventivo, pro natura, de objetivación y de no regresión. El voto particular del magistrado Fernando Cruz consideró, por el contrario, que varias modificaciones carecían de respaldo técnico y disminuían el nivel de protección previamente alcanzado. También estimó insuficiente la consulta pública realizada mediante una página web y defendió la legitimación para tutelar intereses ambientales difusos y la autonomía municipal. Estas conclusiones corresponden al voto disidente y no alteran el rechazo acordado por la mayoría.

La parte recurrente alega violación a los artículos 7, 21, 30, 50, 69 y 89 de la Constitución Política, así como a tratados internacionales, al considerar que la pesca de arrastre es insostenible, ignora el principio precautorio, afecta la seguridad alimentaria, la transparencia y el ambiente. La Sala, por mayoría, resuelve reservar el dictado de la sentencia y conferir a la parte recurrente un plazo de 15 días hábiles para que interponga acción de inconstitucionalidad contra el párrafo segundo del artículo 18 de la Ley de Pesca y Acuicultura, por considerar que los permisos se sustentan en dicha norma. Advierte que, de no interponerse la acción, se archivará el expediente. Cuenta con un voto salvado de tres magistrados que estimaron innecesario el trámite de inconstitucionalidad y que debía resolverse el amparo con los elementos del expediente, y una nota del magistrado Cruz Castro quien considera que los permisos transgreden la prohibición de la pesca de arrastre y violan el derecho al ambiente.

Public Access to Mining Concession Topographic ProfilesAcceso público a perfiles topográficos de concesiones mineras

The Constitutional Chamber granted an amparo against MINAE for denying access to topographic profiles associated with a concession to extract materials from the Chirripó River. It held that the profiles can be used to determine whether the riverbed is being overexploited and therefore contain information connected with potential environmental harm. Because mining is environmental in nature, the principle of maximum disclosure and the State’s corresponding transparency obligation apply. Information in a mining-concession file is public unless a statute authorizes secrecy for a legitimate purpose and the restriction is necessary and proportionate; those conditions were not established here. Possible misinterpretation, illegitimate use, unfair competition, or infringement of intellectual-property rights does not justify withholding the information. The Chamber found violations of Articles 27 and 30 of the Constitution and ordered the authorities to provide the requested material within fifteen days without requiring the applicant to demonstrate a particular interest. One justice dissented, favoring review by the ordinary courts.La Sala Constitucional declaró con lugar el amparo interpuesto contra el MINAE por negar acceso a los perfiles topográficos relacionados con una concesión para extraer materiales del río Chirripó. Debido a la naturaleza ambiental de la minería, rigen el principio de máxima divulgación y la obligación estatal de transparencia. La información incorporada al expediente de una concesión es pública salvo que una norma de rango legal autorice, de forma necesaria y proporcional, mantenerla secreta, supuesto que no se acreditó. El riesgo de interpretaciones incorrectas, usos ilegítimos, competencia desleal o infracciones de propiedad intelectual no justifica restringir el acceso. La Sala tuvo por vulnerados los artículos 27 y 30 de la Constitución y ordenó entregar la información en quince días, sin exigir que el solicitante demostrara un interés particular. Una magistrada salvó el voto.

Marina Concessions in Wetlands and Final Environmental LicensingConcesiones de marinas en humedales y licencia ambiental definitiva

The Constitutional Chamber denied the challenge to Articles 1 and 5 of the Tourist Marinas and Berthing Facilities Concession and Operation Law. It held that allowing concessions in certain wetlands does not, by itself, violate Articles 7 and 50 of the Constitution, the Ramsar Convention, or the principle of environmental non-regression. The law excludes mangroves, wetlands containing coral ecosystems, and wetlands belonging to the State Natural Heritage from concession, whether or not they have been formally designated as protected wildlife areas. Other wetlands remain subject to applicable environmental restrictions and safeguards, including wetlands located on private property. The Chamber also read Articles 5 and 8 together: the potential environmental viability required during CIMAT proceedings does not replace SETENA’s final environmental viability or license, which must be obtained before the concession is granted. The appropriate environmental assessment instrument must be selected according to the nature of each project and the governing environmental regulations.La Sala Constitucional rechazó la acción contra los artículos 1 y 5 de la Ley de Concesión y Operación de Marinas y Atracaderos Turísticos. Determinó que la posibilidad de otorgar concesiones en ciertos humedales no vulnera por sí misma los artículos 7 y 50 constitucionales, la Convención Ramsar ni el principio de no regresión ambiental. La ley excluye de concesión los manglares, los humedales con ecosistemas coralinos y los humedales integrantes del Patrimonio Natural del Estado, sean o no áreas silvestres protegidas. Los demás humedales siguen sometidos a las limitaciones y salvaguardas ambientales aplicables, incluso cuando se ubican en propiedad privada. La Sala también interpretó conjuntamente los artículos 5 y 8: la viabilidad ambiental potencial exigida ante la CIMAT no sustituye la viabilidad o licencia ambiental definitiva de SETENA, que debe obtenerse antes de otorgar la concesión. El instrumento de evaluación correspondiente debe determinarse según la naturaleza de cada proyecto y la normativa ambiental vigente.

Public Hearings Before the Environmental Administrative TribunalAudiencias públicas ante el Tribunal Ambiental Administrativo

The Constitutional Chamber struck down the word “private” in Article 24 of the Rules of Procedure of the Environmental Administrative Tribunal. It held that public participation in environmental matters is both a fundamental right and a constitutional principle applicable to administrative proceedings because environmental protection concerns a diffuse interest and environmental harm affects the entire community. Once the preliminary investigation has concluded, Tribunal hearings must therefore be public, allowing any person to observe the proceeding and participate in protecting the environment. Public access is also part of substantive due process, an expression of participatory democracy, and a means of enforcing the guarantees contained in Article 50 of the Constitution. Nevertheless, the Tribunal may order, through a reasoned decision, that all or part of a hearing be conducted privately when legitimate concerns involving confidentiality, privacy, the presumption of innocence, or protection of an investigation so require. The invalidation took general effect from the date of the judgment and did not prejudice rights acquired in good faith.La Sala Constitucional declaró inconstitucional la palabra «privada» del artículo 24 del Reglamento de Procedimiento del Tribunal Ambiental Administrativo. Determinó que la participación ciudadana en asuntos ambientales es un derecho fundamental y un principio constitucional que alcanza los procedimientos administrativos, pues el ambiente constituye un interés difuso cuya afectación recae sobre toda la comunidad. Una vez terminada la investigación preliminar, las audiencias del Tribunal deben ser públicas para permitir que cualquier persona conozca el procedimiento y participe en la defensa del ambiente. La publicidad también integra el debido proceso sustantivo, expresa la democracia participativa y hace efectivas las garantías del artículo 50 constitucional. No obstante, el Tribunal puede disponer, mediante resolución razonada, que toda la audiencia o una parte de ella sea privada cuando existan motivos legítimos de confidencialidad, intimidad, presunción de inocencia o protección de la investigación. La anulación produjo efectos generales desde la fecha de la sentencia, sin afectar derechos adquiridos de buena fe.

Temporary Mining Extraction Subject to Environmental ReviewExtracción minera temporal sujeta a control ambiental

The Constitutional Chamber reviewed a challenge to Article 39 of the Mining Code and regulations governing special procedures for extracting material from quarries and publicly owned riverbeds. It held that Article 39 does not exempt temporary concessions from environmental controls: the provision must be read together with constitutional Article 50, environmental-impact-assessment rules, and the powers of SETENA and the Directorate of Geology and Mines. For extraction of up to 20,000 cubic meters, classified as category B2 with low potential environmental impact, the legal framework requires a specific environmental instrument, environmental approval, technical oversight, an environmental bond, and preventive measures. Under the in dubio pro natura principle, the Directorate may suspend operations, while noncompliance may lead to cancellation of the permit or concession. The Chamber therefore denied the challenge concerning Article 39 and Article 2 of Executive Decree 33777-MINAE and summarily rejected the remaining claims.La Sala Constitucional examinó la impugnación del artículo 39 del Código de Minería y de normas reglamentarias que regulaban procedimientos especiales para extraer materiales de canteras y cauces de dominio público. Concluyó que el artículo 39 no exime a las concesiones temporales de los controles ambientales: debe interpretarse conjuntamente con el artículo 50 constitucional, la normativa de evaluación de impacto ambiental y las competencias de SETENA y de la Dirección de Geología y Minas. Para extracciones de hasta 20.000 metros cúbicos, clasificadas como categoría B2 de bajo impacto ambiental potencial, el ordenamiento exige un instrumento ambiental específico, viabilidad ambiental, fiscalización técnica, garantía ambiental y medidas preventivas. La Dirección puede suspender labores bajo el principio in dubio pro natura, y el incumplimiento puede causar la cancelación del permiso o concesión. Por ello, la Sala declaró sin lugar la acción respecto del artículo 39 y del artículo 2 del Decreto Ejecutivo 33777-MINAE; los restantes extremos fueron rechazados de plano.

Duty to enforce demolition of illegal works in public streambedDeber de ejecución efectiva de demolición por obras ilegales en cauce

A property owner neighboring Quebrada El Rastro in Atenas filed an amparo against the Municipality of Atenas and MINAE for institutional failure to act against illegal works built by a third party within a public-domain streambed. MINAE's Dirección de Agua had issued a permit for placement of medium rocks, but the permittee instead built a mesh-and-cement wall approximately 15 meters long that throttled the channel and diverted water toward the complainant's property. After an inspection on March 25, 2026, the Dirección de Agua confirmed illegality and ordered demolition within 8 business days but did not enforce its own order. The Constitutional Chamber granted the amparo and ordered MINAE's water directorate to execute the demolition within three months—using substituted administrative execution if necessary—and the Municipality to provide institutional cooperation. The ruling develops the precautionary, prevention, in dubio pro natura, and non-regression principles, and incorporates IACHR OC-32/25 on the climate emergency.Un vecino colindante con la quebrada El Rastro en Atenas interpuso recurso de amparo contra la Municipalidad de Atenas y el MINAE alegando omisión institucional frente a obras ilegales realizadas por un tercero dentro del cauce de dominio público. La Dirección de Agua había otorgado permiso para colocación de rocas medianas, pero el particular construyó un muro de malla y cemento de aproximadamente 15 metros que estrangulaba el cauce y desviaba el flujo hacia la propiedad del recurrente. Tras inspección del 25 de marzo de 2026, la Dirección de Agua confirmó la ilegalidad y ordenó demolición en 8 días hábiles, pero no ejecutó la medida. La Sala Constitucional declaró el amparo con lugar y ordenó que la Dirección de Agua materialice la demolición en 3 meses —incluida la ejecución sustitutiva si el obligado incumple— y que la Municipalidad preste colaboración interinstitucional. La sentencia desarrolla los principios precautorio, preventivo, in dubio pro natura y no regresión ambiental, e incorpora la OC-32/25 de la Corte IDH sobre cambio climático.
